Public Health (General) Amendment (Register of Congenital Conditions) Regulation 2009

Public Health Act 1991

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Public Health Act 1991.

Explanatory note
The object of this Regulation is to update references to certain forms referred to in the Public Health (General) Regulation 2002. The forms are used by medical practitioners and chief executive officers of public hospitals to notify the Director-General of the Department of Health (for inclusion on the NSW Register of Congenital Conditions) of any congenital condition that is diagnosed by prenatal diagnosis or diagnosed in an infant.
This Regulation is made under the Public Health Act 1991, including sections 14 (2) (c),

69 (2) and 82 (the general regulation-making power).

Congenital Conditions) Regulation 2009

1      Name of Regulation

This Regulation is the Public Health (General) Amendment (Register of
Congenital Conditions) Regulation 2009.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Public Health (General) Regulation 2002

Omit “the “NSW Birth Defects Register Notification of Birth Defect Form” or the “NSW Birth Defects Register Notification of Pregnancy with a Baby Affected by Congenital Malformation Form”,” from clauses 6 (f) and 19 (b), wherever occurring.

Insert instead “the form entitled “Notification of a scheduled congenital condition diagnosed in an infant” or “Notification of a scheduled congenital condition diagnosed by prenatal diagnosis”,”.
