Public Health (Food Hygiene) Amendment Regulations 1998

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Public Health Act 1962 .22 January 1998

1Short titleThese regulations may be cited as the Public Health (Food Hygiene) Amendment Regulations 1998 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Public Health (Food Hygiene) Regulations 1977 are referred to as the Principal Regulations. 4Regulation 7 amended (Cleanliness of premises)Regulation 7 of the Principal Regulations is amended by omitting subregulation (5). 5Regulation 12A amended (Storage of fish offered for sale)Regulation 12A of the Principal Regulations is amended as follows: (a) by inserting in paragraph (a)"at a temperature not exceeding 5 degrees Celsius or" after "stored"; (b) by omitting from paragraph (b)"of 0 degree to 1 degree" and substituting "not exceeding 5 degrees". 6Regulation 21 amended (Interpretation)Regulation 21 of the Principal Regulations is amended by inserting the following definitions before the definition of “butcher’s meat”: ARMCANZ means the Agricultural and Resource Management Council of Australia and New Zealand; ARMCANZ Standards means the following Standards issued by ARMCANZ: (a) Australian Standard for Construction of Premises Processing Meat for Human Consumption; (b) Australian Standard for Hygienic Production of Meat for Human Consumption; (c) Australian Standard for Transportation of Meat for Human Consumption. 7Regulation 22 rescindedRegulation 22 of the Principal Regulations is rescinded. 8Regulations 23 and 24 substitutedRegulations 23 and 24 of the Principal Regulations are rescinded and the following regulations are substituted: 23Standards relating to protection of meat The methods and precautions to be adopted to protect meat and meat products from contamination or deterioration are those specified in the following Standards: (a) the ARMCANZ Standards; and (b) the Tasmanian Standard for Premises Processing and Retailing Meat for Human Consumption issued by the Department of Community and Health Services. 24Standards relating to cleanliness of butcher's shops The provisions to be complied with in relation to the securing of cleanliness and freedom from contamination in respect of butcher’s shops are specified in the following Standards: (a) the ARMCANZ Standards; and (b) the Tasmanian Standard for Premises Processing and Retailing Meat for Human Consumption issued by the Department of Community and Health Services. 9Regulations 25 and 26 rescindedRegulations 25 and 26 of the Principal Regulations are rescinded. 10Regulation 27 substitutedRegulation 27 of the Principal Regulations is rescinded and the following regulation is substituted: 27Offences A person must not use, or permit to be used, a butcher’s shop – (a) for domestic purposes; or (b) as a sleeping apartment; or (c) into which a sleeping-room opens directly; or (d) for any purpose incompatible with the cleanliness and good sanitary condition of the shop or any fittings and instruments used, or meat exposed, in the shop. 11Regulation 30 amended (Requirements in relation to premises)Regulation 30 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (2) "the Minister" and substituting "a municipal health surveyor"; (b) by omitting from subregulation (3) ", when required by the Minister"; (c) by omitting from subregulation 4) paragraphs (a), (b), (c) and (d) and substituting the following paragraphs: (a) milk referred to in Standard H1 of the Australian Food Standards Code; or (b) milk products referred to in Standards H2, H5, H6, H8, H9 and H10 of the Australian Food Standards Code. (d) by omitting subregulations (5) and (6). 12Regulation 33 amended (Refrigerators in milk shops)Regulation 33(2) of the Principal Regulations is amended by omitting paragraphs (a), (b), (c) and (d) and substituting the following paragraphs: (a) milk referred to in Standard H1 of the Australian Food Standards Code; or (b) milk products referred to in Standards H2, H5, H6, H8, H9 and H10 of the Australian Food Standards Code. 13Regulation 90 amended (Contravention of regulations)Regulation 90 of the Principal Regulations is amended by omitting "2 penalty units" and substituting "30 penalty units".

EXPLANATORY NOTE

(This note is not part of the regulation) These regulations amend the

(a) by adopting standards relating to the protection of meat and the cleanliness of butcher’s shops; and (b) byamending provisions relating to the sale of fresh fish; and (c) by amending provisions relating to milk and dairy products; and (d) by providing that a municipal health surveyor may approve a vehicle to be used for the delivery of both bread and milk; and (e) by rescinding certain provisions.
