Public Health (Consequential Amendments) Act 1999

An Act to amend certain laws consequent on the enactment of the Public Health Act 1997

[Notified in ACT Gazette S16: 14 April 1999]

The Legislative Assembly for the Australian Capital Territory enacts as follows:

  1. Short title

    This Act may be cited as the Public Health (Consequential Amendments) Act 1999.

  2. Commencement

    This Act commences immediately after the commencement of section 44 of the Public Health (Miscellaneous Provisions) Act 1997.

  3. Amendments

  4. The Acts specified in Schedule 1 are amended as set out in that Schedule.

  5. The Regulations specified in Schedule 2 are amended as set out in that Schedule.

SCHEDULE 1  Subsection 3 (1)

AMENDMENTS OF ACTS

Motor Traffic Act 1936

Subsection 26T (2)—

Omit “, section 32 and subsections 35 (3) and (4)”, substitute “and section 32,”.

Section 35—

Repeal the section.

Public Baths and Public Bathing Act 1956

Paragraph 12 (1) (b)—

Omit the paragraph, substitute the following paragraph:

“(b)if the person is suffering from a skin disease or infection;”.

Paragraph 17 (p)—

Omit the paragraph, substitute the following paragraph:

“(p)enter or remain in any public baths while the person is knowingly suffering from a skin disease or infection;”.

SCHEDULE 2  Subsection 3 (2)

AMENDMENTS OF REGULATIONS

Motor Omnibus Regulations

Paragraph 55 (1) (a)—

Omit the paragraph.

Regulation 79—

Repeal the regulation.

Motor Omnibus Services Regulations

Paragraph 13 (1) (a)—

Omit the paragraph.

Regulation 32—

Repeal the regulation.

Remand Centres Regulations

Subregulation 9 (3)—

Omit “shall”, substitute “may”.

Taxi and Private Hire Car Regulations

Paragraph 11 (2) (a)—

Omit the paragraph, substitute the following paragraph:

“(a)if the person offering the hiring is drunk or dirty or attired so as to be likely to soil or damage the vehicle; or”.

Paragraph 46 (a)—

Omit the paragraph.

NOTE

Regulation headings

On the day on which the regulations specified below are amended by this Act, and after the alterations to the headings of those regulations specified in the Notes to the Public Health (Miscellaneous Provisions) Act 1997 have been made, the headings to the regulations are further altered as set out in the following table:
