Public Health and Wellbeing (Prescribed Accommodation) Amendment Regulations 2021

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend


the Public Health and Wellbeing (Prescribed Accommodation) Regulations 2020 to substitute the definition of rooming house.

2Authorising provisions

These Regulations are made under sections 232 and 235 of the Public Health and Wellbeing Act 2008.

3Commencement

These Regulations come into operation on
12 June 2021.

4Regulation 5 amended

In regulation 5 of the Public Health and Wellbeing (Prescribed Accommodation) Regulations 2020[1], for the definition of rooming house substitute

"rooming house has the same meaning as it has in section 3(1) of the Residential Tenancies Act 1997, but in respect of a building referred to in paragraph (b) of that definition, does not include a building in respect of which a declaration under section 19(2) or (3) of that Act is in force, if—

(a)the building has less than 4 occupants; or

(b)the building has 4 or more occupants who all reside in self-contained apartments;".
