Public Health and Wellbeing Amendment Regulations 2018

The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Public Health and Wellbeing Regulations 2009—

(a)to prescribe infectious diseases to be a notifiable condition;

(b)to prescribe medical conditions to be a notifiable condition;

(c)to prescribe the notification details and the period within which a registered medical practitioner must notify the Secretary of a notifiable condition;

(d)to prescribe the notification details and the period within which the person in charge of a pathology service must notify the Secretary of a notifiable condition.

2Authorising provisions

These Regulations are made under sections 232 and 238 of the Public Health and Wellbeing Act 2008.

3Commencement

These Regulations come into operation on 1 September 2018.

4Principal Regulations

In these Regulations, the Public Health and Wellbeing Regulations 2009[1] are called the Principal Regulations.

5Notifiable conditions and micro-organisms

For regulation 70(1) of the Principal Regulations substitute

"(1)For the purposes of the definition of notifiable condition in section 3(1) of the Act, the prescribed infectious diseases and the prescribed medical conditions are the infectious diseases and the medical conditions set out in Part 1 and Part 2 of Schedule 4 and Part 1 and Part 2 of Schedule 6.".

6Regulation 71 substituted

For regulation 71 of the Principal Regulations substitute

"71   Notification of notifiable conditions—registered medical practitioners

For the purposes of section 127(2)(a) of the Act—

(a)for a notifiable condition set out in item 1 of Part 1 of Schedule 4—

(i)the prescribed period is the period set out in item 2 of Part 1 of Schedule 4; and

(ii)the notification details to be provided are the details set out in Part 3 of Schedule 4; and

(b)for a notifiable condition set out in item 1 of Part 2 of Schedule 4—

(i)the prescribed period is the period set out in item 2 of Part 2 of Schedule 4; and

(ii)the notification details to be provided are the details set out in Part 3 of Schedule 4.".

7Regulation 72 substituted

For regulation 72 of the Principal Regulations substitute

"72   Notification of notifiable conditions—the person in charge of a pathology service

For the purposes of section 128(2)(a) of the Act—

(a)for a notifiable condition set out in item 1 of Part 1 of Schedule 6—

(i)the prescribed period is the period set out in item 2 of Part 1 of Schedule 6; and

(ii)the notification details to be provided are the details set out in Part 3 of Schedule 6; and

(b)for a notifiable condition set out in item 1 of Part 2 of Schedule 6—

(i)the prescribed period is the period set out in item 2 of Part 2 of Schedule 6; and

(ii)the notification details to be provided are the details set out in Part 3 of Schedule 6.".

8Schedule 4 substituted

For Schedule 4 of the Principal Regulations substitute
