Public Health and Wellbeing Amendment Act 2019

The Parliament of Victoria enacts:

1Purpose

The purpose of this Act is to amend the Public Health and Wellbeing Act 2008—

(a)to remove requirements in relation to the provision of information before and after HIV testing; and

(b)to make minor miscellaneous amendments.

2Commencement

(1)This Act (except sections 4, 5 and 6) comes into operation on the day after the day on which this Act receives the Royal Assent.

(2)Subject to subsection (3), sections 4, 5 and 6 come into operation on a day to be proclaimed.

(3)If a provision referred to in subsection (2) does not come into operation before 15 December 2019, it comes into operation on that day.

3Principal Act

In this Act, the Public Health and Wellbeing Act 2008 is called the Principal Act.

4Definition of prescribed disease

(1)In section 3(1) of the Principal Act, the definition of prescribed disease is repealed.

(2)In section 238(1)(o) of the Principal Act omit "for the purposes of Division 8 of Part 8".

5Amendment of heading

For the heading to Division 4 of Part 8 of the Principal Act substitute—

"Division 4—Closure of court or tribunal".

6Repeals

(1)Section 131 of the Principal Act is repealed.

(2)Section 132 of the Principal Act is repealed.

(3)Section 238(1)(l) of the Principal Act is repealed.

7Statute law revision amendments

(1)In section 3(1) of the Principal Act, in the definition of Department, for "Department of Health" substitute "Department of Health and Human Services".

(2)In section 16(1) of the Principal Act, for "Department of Health" substitute "Department of Health and Human Services".

(3)In the heading to section 65 of the Principal Act, for "districts" substitute "district".

(4)In section 148(1) of the Principal Act, for "statue" substitute "status".

8Repeal of this Act

This Act is repealed on 15 December 2020.

Note

The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
