Influenza) Regulation 2010

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Public Health Act 1991.

Explanatory note
The object of this Regulation is to amend the Public Health Act 1991 so that swine influenza in humans:

(a) is no longer a scheduled medical condition, and
(b) is no longer a notifiable disease.

As a result, the notification obligations applicable to medical practitioners under the Act, and certain other special requirements, will no longer apply in respect of that medical condition. This Regulation is made under the Public Health Act 1991, including sections 80 and 82 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Public Health Amendment (Swine Influenza)
Regulation 2010.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Public Health Act 1991 No 10

(1) Schedule 1 Scheduled medical conditions

Omit “Swine influenza in humans” wherever occurring in Categories 2,

3 and 4.

(2) Schedule 3 Notifiable diseases
Omit “Swine influenza in humans”.
