Influenza) Regulation 2009

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Public Health Act 1991.

Explanatory note
The object of this Regulation is to amend the Public Health Act 1991:

(a) to include swine influenza in humans in the list of medical conditions in Schedule 1 to the Act that must be notified by medical practitioners and laboratories to the Director-General of the Department of Health (the Director-General), and
(b) to require a person suffering from swine influenza to take reasonable precautions against spreading the condition, and
(c) to allow the Director-General to order a person to undergo a medical examination if the Director-General suspects on reasonable grounds that the person is suffering from swine influenza, and
(d) to allow an authorised medical practitioner who is satisfied on reasonable grounds that a person is suffering from swine influenza to make a public health order in respect of the person, and
(e) to include swine influenza in the list of diseases in Schedule 3 to the Act that must be notified by hospitals to the Director-General.

This Regulation is made under the Public Health Act 1991, including sections 80 and 82 (the general regulation-making power).
