I, the Minister for Health, in pursuance of sections 51 (2) and 81 of the Public Health Act 2010, make the following Order.

Explanatory note
The object of this Order is to remove Acquired Immune Deficiency Syndrome (AIDS) from the list of medical conditions and notifiable diseases under the Public Health Act 2010 (the Act), which will have the following effects:
| (a) | medical practitioners, laboratories, and the Chief Health Officer of a hospital will no longer be required to notify the Secretary of the Ministry of Health of the incidence of AIDS, |
| (b) | offence provisions relating to the spread of certain medical conditions under the Act will no longer apply to AIDS, |
| (c) | a public health order under the Act may no longer be made in relation to the incidence of AIDS. |
Human Immunodeficiency Virus (HIV) infection remains listed as a medical condition and notifiable disease under the Act.
This Order is made under sections 51 (2) and 81 of the Public Health Act 2010.

This Order is the Public Health Amendment (Scheduled Medical Conditions and
Notifiable Diseases) Order 2018.
2 Commencement
This Order commences on the day on which it is published on the NSW legislation website.
3 Amendment of Public Health Act 2010 No 127
(1) Schedule 1 Scheduled medical conditions Omit “Acquired Immune Deficiency Syndrome (AIDS)” from the matter under the headings Category 2 and Category 5.
(2) Schedule 2 Notifiable diseases Omit “Acquired Immune Deficiency Syndrome (AIDS)”.
