Explanatory note
The object of this Regulation is to provide that identifying particulars and information contained in the Pap

1      Name of Regulation

This Regulation is the Public Health Amendment (Pap Test Register) Regulation
2016.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Public Health Regulation 2012

Clauses 93B and 93C

Insert after clause 93A:

93B Pap Test Register—disclosure of identifying particulars

For the purposes of section 92 (2) of the Act, a person may disclose the identifying particulars of a woman who has had a cervical cancer test, in conjunction with the result of the test, for the purposes of the National Cancer Screening Register to:

(a)

an officer or employee of the Commonwealth or an authority of the Commonwealth, or

(b)

a person engaged by the Commonwealth, or an authority of the Commonwealth, to perform work relating to those purposes, or

(c)

an officer or employee of a person referred to in paragraph (b), or engaged by a person referred to in paragraph (b), to perform work relating to those purposes.

93C Pap Test Register—disclosure of information

For the purposes of section 130 (e) of the Act, a person who discloses any information contained in the Pap Test Register and obtained in connection with the administration or execution of the Act is not guilty of an offence if the disclosure is made for the purposes of the National Cancer Screening Register to:

(a) an officer or employee of the Commonwealth or an authority of the Commonwealth, or
(b) a person engaged by the Commonwealth, or an authority of the Commonwealth, to perform work relating to those purposes, or
(c) an officer or employee of a person referred to in paragraph (b), or engaged by a person referred to in paragraph (b), to perform work relating to those purposes.
