Regulation under the Public Health Act 2010.

Explanatory note
The object of this Regulation is to ensure certain facilities continue to be nursing homes for the purposes of the Public Health Act 2010 following recent amendments to the Aged Care Act 1997 of the Commonwealth. This Regulation is made under the Public Health Act 2010, including section 5 (1) (definition of nursing home) and section 134 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Public Health Amendment (Nursing Homes) Regulation 2014.
2 Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.
3 Amendment of Public Health Regulation 2012
Clause 95A
Insert after clause 95:
95A Nursing homes A facility that was a nursing home for the purposes of the Act immediately before 1 July 2014 is prescribed for the purposes of paragraph (b) of the definition of nursing home in section 5 (1) of the Act.
