His Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the Public Health Act 2010.

Explanatory note
The object of this Regulation is to permit the disclosure of information that was on the Pap Test Register
before the provisions of the Public Health Act 2010 about that Register were repealed.
This Regulation is made under the Public Health Act 2010 (as amended by the Public Health Amendment
(Review) Act 2017), including sections 130 (Disclosure of information) and 134 (the general
regulation-making power) and clause 1 of Schedule 5.

1 Name of Regulation
This Regulation is the Public Health Amendment (Disclosure of Information on
Former Pap Test Register) Regulation 2018.
2 Commencement
This Regulation commences on 1 May 2018 and is required to be published on the
NSW legislation website.
3 Amendment of Public Health Regulation 2012
(1) Clause 93B Disclosure of identifying particulars of women who had cervical
screening testsOmit “For the purposes of section 92 (2) of the Act”.
Insert instead “On and from the repeal of provisions of the Act about the former Pap
Test Register (on 1 May 2018)”.
(2) Clause 93B (d) and (e) Insert at the end of clause 93B (c): , or
(d)
a health practitioner engaged by the woman to take a specimen from her for the purposes of a cervical screening test, or
(e)
a laboratory engaged on the woman’s behalf to make a pathological or cytological examination of a specimen taken from her for the purposes of a cervical screening test.
(3) Clause 93C Disclosure of information on former Pap Test Register Omit “the Pap Test Register”. Insert instead “the former Pap Test Register immediately before the repeal of provisions of the Act about that Register (on 1 May 2018)”.
(4) Clause 93C (d) and (e) Insert at the end of clause 93C (c): , or
(d) a health practitioner engaged by the woman to take a specimen from her for the purposes of a cervical screening test, or (e) a laboratory engaged on the woman’s behalf to make a pathological or cytological examination of a specimen taken from her for the purposes of a cervical screening test.
