Her Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the Public Health Act 2010.

Explanatory note
The object of this Regulation is to allow for the issue of penalty notices for an offence against section 10 of the Public Health Act 2010 involving a contravention of a Ministerial direction under the Public Health
(COVID-19 Spitting and Coughing) Order 2020 about intentionally spitting or coughing on a public official
in a way that is likely to cause fear about the spread of COVID-19.
This Regulation is made under the Public Health Act 2010, including sections 118 and 134 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Public Health Amendment (COVID-19 Spitting and
Coughing) Regulation 2020.
2 Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.
3 Amendment of Public Health Regulation 2012
Schedule 4 Penalty notice offences
Omit the entry relating to section 10 of the Act under the heading “Part 1 Offences under the Act”.
Insert instead—
Section 10, for an offence against clause 5 of $5,000 the Public Health (COVID-19 Spitting and Coughing) Order 2020 Section 10, for another offence occurring
$1,000 $5,000 between 26 March 2020 and 25 March 2021
