An Act to amend the Public Health Act 1997

The Legislative Assembly for the Australian Capital Territory enacts as follows:

  1. Name of Act

    This Act is the Public Health Amendment Act 2020 (No 2).

  2. Commencement

    This Act commences on the day after its notification day.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This Act amends the Public Health Act 1997.

  4. Determination of fees
    New section 137 (1A) and (1B)

    insert

    (1A)A fee (a quarantine fee) may be determined in relation to costs incurred, or to be incurred, by the Territory in relation to a requirement for a person to quarantine at a place other than the person’s home because of the coronavirus disease 2019 (COVID-19) caused by the novel coronavirus SARS-CoV-2.

    NotePower to make a statutory instrument (including a determination) about a particular matter does not limit power to make a determination about any other matter (see Legislation Act, s 44 (3)).

    (1B)If a person required to pay a quarantine fee asks for payment of the fee to be in instalments, deferred or waived, in considering the request, the Minister must take into account the person’s circumstances, including whether they are suffering financial hardship.
