Public Health Act 1991

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Public Health Act 1991.

Explanatory note
The objects of this Regulation are:

(a) to vary the restrictions on the manner in which an advertisement may be created by an arrangement of tobacco products in a shop or retail premises, and
(b) to remove any doubt that, for the purposes of reckoning the number of cigarette cartons that may be visible in such an arrangement, cartons whose outer wrappings are all transparent must be counted, and
(c) to make further provision with respect to the dimensions of health warning signs required to be displayed in connection with the sale of tobacco products.

This Regulation is made under Part 6 of the Public Health Act 1991, in particular sections 61B and 61P.

This Regulation commences on 24 December 1999.

3 Amendment of Public Health (Tobacco) Regulation 1999

The Public Health (Tobacco) Regulation 1999 is amended as set out in Schedule 1.

Schedule 1 Amendments

(Clause 3)

[1]      Clause 8 General requirements relating to display of packages

Insert after clause 8 (2):

(2A) Subclause (2) does not prevent the placement of cigarette cartons one behind the other so that some surfaces (but not the whole or part of any of the package facings) of cartons placed behind the first are visible.

[2]      Clause 8 (9)

Insert “in one or more outer wrappings (whether or not any such wrapping is transparent)” after “packets” in paragraph (b) of the definition of cigarette carton.

[3]      Clause 12 Health warning at point of sale

Insert “be between 50 and 100 centimetres wide and” before “have” in clause 12 (4) (a).
