Medical Conditions) Regulation 2000

Public Health Act 1991

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Public Health Act 1991.

Explanatory note

The Public Health Act 1991 imposes certain obligations on persons suffering from prescribed medical conditions and on medical or laboratory staff who treat or test those persons. In the case of a condition prescribed by the Act as a Category 3 medical condition, the person suffering from it is required to take reasonable steps to prevent its contagion, and a testing laboratory is required to notify any detected instance of it to the Director-General of the Department of Health. In the case of a condition prescribed as a notifiable disease, hospital administrators are obliged to report any hospitalised case to the Director-General.

The objects of this Regulation are:

(a)

to add six new conditions to the list of Category 3 medical conditions, and to remove “mycobacterial infections” from that list, and

(b) to add the condition known as Lyssavirus to the list of notifiable diseases.

This Regulation is made under section 80 of the Act.

1     Name of Regulation

This Regulation is the Public Health Amendment (Scheduled Medical
Conditions) Regulation 2000.

2 Amendment of Public Health Regulation 1991

The Public Health Regulation 1991 is amended as set out in

Schedule 1.

The explanatory note does not form part of this Regulation.
