Public Health Amendment Regulation

His Excellency the Governor, with the advice of the Executive Council, has

made the following Regulation under the Public Health Act 1991.

Explanatory note

Under section 16 of the Public Health Act 1991 a person who certifies a positive result of a serological or other prescribed medical test that detects that a person is suffering from a Category 3 medical condition must notify the Director-General of the Department of Health in the approved form. The object of this Regulation is to prescribe certain tests for the purposes of that section.

This Regulation is made under the Public Health Act 1991, including sections 16 (Notification of test results—Category 3 medical condition) and 82 (the general regulation-making power).

Clause 6AA

Omit the clause. Insert instead:

6AA Notification of test results—prescribed tests

For the purposes of section 16 (1) (a) of the Act, any diagnostic test on the following substances, or any constituent of the following substances, is a prescribed test:

(a) human blood,
(b) human cells,
(c) human tissue,
(d) other bodily substances.
