No. 18 of 1930.

AN ORDINANCE

To amend the Public Health Ordinance 1928, and

for other purposes.

BE it ordained by the person administering the Government of Federal Executive Council, in pursuance of the powers conferred the Commonwealth of Australia, with the advice of the by the Seat of Government Acceptance Act 1909 and the Seat of
Government (Administration) Act 1910-1930, as follows:—
1.—(1.) This Ordinance mav be cited as the Public Health short title and citetlon-
Ordinance 1930. -

(2.) The Public Health Ordinance 1928 is in this Ordinance

referred to as the Principal Ordinance.

(3.) The Principal Ordinance, as amended by this Ordinance,

may be cited as the Public Health Ordinance 1928-1930.

2. The Cattle Testing Ordinance 1924 and the Dairies Super- Repeal.

vision Ordinance 1925 are repealed.

3. Section four of the Principal Ordinance is amended— Definition.

(a) by inserting, before the definition of "Drug" , the

following definitions.-—

"Authorized" means authorized in writing by the

" Director-General" means the Director-General

of Health; ' ' and

(6) by omitting the word "Commission" (wherever occur-

ring) and inserting in its stead the word "Minister".

(a) by omitting the word "Commission" (wherever occur-

ring) and inserting in its stead the word "Minister";

Appointment of 6. After section six of the Principal Ordinance the following
inspectors. section is inserted :—
" 6 A . The Minister may appoint such Inspectors of Health as he thinks necessary for the purposes of this Ordinance and any Inspector so appointed shall have such powers and functions as are prescribed."
Powers of 7. Section seven of the Principal Ordinance is amended—

Director- General.

(a) by inserting, before the words " The Medical Officer

of Health", the words "The Director-General and" ;

and

(b) by omitting the word " h i m " and inserting in its stead

the word " them".

Powers of 8. Section eight of the Principal Ordinance is repealed and
officers. the following section inserted in its stead:—

" 8 . For the purposes of carrying the provisions of this Ordinance into effect, the Director-General, the Medical Officer of Health, any Inspector or any authorized person may exercise such powers and shall perform such duties as are conferred or imposed on him by this Ordinance".

Proceedings 9. Section eleven of the Principal Ordinance is amended—
for offences.

(a) by omitting the word "Commission" (first occurring),

and inserting in its stead the word "Minister";

(b) by omitt ing the words "officer of the Commission thereto authorized in wri t ing by the Commission" and insert ing in their stead the words " p e r s o n thereto authorized in wri t ing by the Minis te r" .

Regulations. 10. Section twelve of the Principal Ordinance is amended—
(a) by omitting the word "Commission" and inserting in

its stead the word "Minister";

(c) by omitting from sub-paragraph (iii) of paragraph

(b) by omitting from paragraph (e) the word " infectious'';

(h) the words "and the food products thereof" and inserting in their stead the words "or for the pro- duction of food products, and the food products of

those animals' ' ;

(d) by omitting sub-paragraph (xii) of paragraph (h)

and inserting in its stead the following words:—

"(xi i ) the housing of birds or animals and the conditions under which they may be kept, and the registration of any premises used for any of these purposes;" ;

(e) bv adding at vlie end of paragraph (1.) the words "and

insects"; and

(/) by inserting, after paragraph (m), the following para-

graphs :•—
" (ma) the disposal of dead animals;

(mb) the registration, branding, testing, examina tion, isolation and destruction of bulls, cows or calves and the payment of com- pensation for tlie destruction of any such animals which are found to be diseased ;".
