PUBLIC HEALTH ACT 1902 - REGULATION
(Relating to use of sleeping accommodation)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Public Health Act 1902, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation takes effect on 1 September 1990.
Amendment
2. The Public Health Regulations are amended by omitting
Regulation 41 and by inserting instead the following Regulation:
Use of sleeping accommodation
41. The occupier of a building must not allow any room or cubicle within the building to be used for the purposes of sleeping accommodation unless the room or cubicle has a floor area of 5.5 square metres or more for each person sleeping therein.

EXPLANATORY NOTE
The object of this Regulation is to amend the Public Health Regulations so as to ensure that rooms and cubicles used for sleeping accommodation have at least 5.5 square metres floor area for each person sleeping in the room or cubicle. This replaces the existing requirement that for each such person there should be at least 14 cubic metres of air space within any room used for sleeping purposes.
