PUBLIC HEALTH ACT 1902—REGULATION

(Exemptions from minimum floor space requirements for sleeping

accommodation)

HIS Excellency the Governor. with the advice of the Executive Council. and in pursuance of the Public Health Act 1902, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 14 December 1990.

Amendment

2. The Public Health Regulations are amended by inserting at the end

of Regulation 41 the following clauses:

(2) The requirements of clause (1) do not apply to any room or

cubicle the subject of an exemption in force under clause (3).
(3) The Minister may, by order in writing, exempt any room or

cubicle from the requirements of clause (1), either conditionally or

unconditionally, if satisfied that the exemption will not result in any

adverse effect on the health of persons sleeping therein.

EXPLANATORY NOTE

The object of this Regulation is to enable the Minister for Health to grant

exemptions from the minimum floor space requirements imposed by Regulation 41

of the Public Health Regulations in relation to room and cubicles used for the
purposes of sleeping accommodation. Such an exemption may only be granted if
the Minister is satisfied that the exemption will not result in any adverse effect on
the health of persons sleeping in the room or cubicle the subject of the exemption.
