BE it enacted by the Queen ' s Most E x c e l l e n t Majesty, by and
w i t h
t he advice and consent of t he Legislat ive Council and Legislat ive Assembly of N e w South Wales
in Pa r l i amen t assembled, and by t h e
au thor i ty of t he same, as follows :—
P A R T I .
APPLICATION OP A C T .
1. E x c e p t as hereinafter provided th is A c t shal l apply to every
place in N e w South "Wales.
2. (I) The provisions of th i s A c t shal l apply to every ship, vessel, boat , t en t , van, shed, or o ther s t ruc tu re which is, has been, or m a y be occupied by m a n , in l ike m a n n e r as near ly as m a y be as if i t were a house, b u t shall not apply to any ship, vessel, or boat belonging to H e r Majes ty the Queen or to any foreign Government .
(II) Any river, harbour , or o ther water shall be deemed for t he
purposes of th is Ac t to be wi th in such district as may be fixed by the Governor by proc lamat ion in t he Gazette.- Provided t h a t the Governor
m a y in t he m a n n e r aforesaid revoke or va ry any proc lamat ion m a d e under th is section.
P A R T I I .
POWERS AND DUTIES OF TILE BOARD AND OF LOCAL AUTHORITIES.
The Board.
3. No twi th s t and ing a n y t h i n g conta ined in the Infect ious
Diseases Supervision Act , 1881, after t h e day w h e n this Act takes effect t h e n u m b e r of t he members of t h e Board of H e a l t h shall be no t less t h a n seven nor more t h a n ten, inclusive of t he president , four of w h o m at least shall be legally qualified medical prac t i t ioners ; and for car ry ing ou t t he provisions of th is section t h e m e m b e r s of t h e board o ther t h a n the pres ident shall on t h a t day vacate the i r offices, and the Governor may thereupon appoin t six persons who, w i th the president , shal l be members of and shal l cons t i tu te t h e board, and m a y remove any m e m b e r and appoint any o ther member in place of a m e m b e r so removed, or in place of any member dying or res igning or becoming incapable to act . B u t no al terat ion in t he
th ings
cons t i tu t ion of t h e board shall affect its incorporat ion unde r t h e
Noxious Trades and Cat t le S laugh te r ing Ac t , 1891 .
Four members of the board shall cons t i tu te a quo rum.
4. The board may exercise any r igh t of en t ry conferred on a local au thor i ty by th is Ac t or by t h e Dair ies Supervision
Ac t .
The board m a y also exercise any of t he powers and per form any of t h e dut ies which a local au thor i ty m a y exercise or perform
under
th is
Ac t . 5. The board shall a t all t imes have access to all repor ts , books,
p lans , accounts , maps , documents , machinery , mater ia l s , and all o ther
th ings whatsoever be longing to or in the custody of any local au thor i ty , or of any contractor wi th a local au thor i ty , and used in t he execution of the provisions of this A c t or in any way in re la t ion there to .
0. The board may m a k e regula t ions as to i ts own proceedings

| duties a n d t h e car ry ing out of t he powers vested | in t h e board by th i s |
Act , or by any regula t ions m a d e by the Governor unde r th i s Ac t .
7. The board m a y cause to be made such inquir ies as it t h i n k s fit in re la t ion to any ma t t e r s concern ing the publ ic heal th , or in relat ion to any m a t t e r s wi th respect to which its sanction, approval , or consent is requi red by th is Act , and for t h a t purpose any person author ised in wr i t ing by the president or by the board m a y at any reasonable t ime enter any premises.
8 . I t shall be lawful for t he Board of H e a l t h , whenever it
deems i t necessary in t he interest of t he publ ic hea l th or t h e hea l th of any persons, on giving the notice prescribed, to enter by i ts members , officers, or servants any premises vested in or under flic control of t h e Metropol i tan Board of W a t e r Supply and Sewerage, or t h e H u n t e r Dis t r ic t W a t e r Supply and Sewerage Board, or t h e council of any munic ipa l i ty , or any o ther person or corporation, for the pur poses of water supply or sewerage, and inspect the same and any works thereon or there in const ructed or used for t he said purposes, and any other works belonging to the W a t e r Supply and Sewerage Board, council , person, or corporation to w h o m notice has been given as aforesaid, or connected t he rewi th and const ructed or used for the said pur]loses.
A n d any W a t e r Supply a n d Sewerage Board , council , person,
or corporat ion as aforesaid, on receiving notice as aforesaid, shall i n s t ruc t their officers and servants to aid and assist t h e Board of H e a l t h in m a k i n g and causing to be made; t he said inspection, and shall pe rmi t t he m e m b e r s of t he Board of H e a l t h , or its officers or servants , to inspect any appa ra tus and th ings used in connect ion with any works of water supply or sewerage of t he said W a t e r Supply and Sewerage Board, council , person, or corporat ion, and any records, books, or p lans re la t ing to t he said works, or to any works connected the rewi th .
The Board of H e a l t h may a t a n y t i m e make n r e p o r t to the
Secretary for Pub l i c Works whenever in its opinion any danger to public hea l th , or to the hea l th of any persons, could be removed or diminished by the exercise by any W a t e r Supply and Sewerage Board, or by t h e council of any munic ipa l i ty , or by any other person or

Local authorities.
9. (I) Subject to the provisions here in contained, this Ac t shall
| be adminis te red | by the following local author i t ies :— |
(a) W i t h i n t h e boundar ies of any munic ipa l i ty now or hereafter
to be cons t i tu ted t he council of t h a t munic ipal i ty . (&) W i t h i n a police distr ict (exclusive of l and wi th in the city of
Sydney or any munic ipa l i ty as aforesaid) such m e m b e r oft he police force; as may be appoin ted by the board by
notification in t h e Gazette.

(II) The local au thor i t ies are hereby author ised and directed to car ry out t h e provisions of this Ac t wi th in t he respective dis tr icts
aforesaid.10. The Governor shall have power to appo in t a legal ly qualified medical pract i t ioner to be medical officer of hea l th for a dis t r ic t or g roup of distr icts , a t such salary as may be determined b y the Governor and provided for out of funds voted b y P a r l i a m e n t for
t he purpose. The president of t he board shall have all the powers of a
medica l officer of hea l th , and may exercise t he same when, in hisopinion, necessary in any such munic ipa l i ty or police distr ict , or in
any sani tary area u n d e r section forty-eight . 1 1 . A medical officer of heal th shall in addi t ion to t he powers
conferred on h i m by or under th is Act have all the powers conferred by th i s A c t or by any regulat ions t he reunde r on a san i ta ry inspector

local au thor i ty , and may a t such o ther t imes as he t h i n k s proper, repor t to t h e said au thor i ty on the sani ta ry condition of their dis t r ic t , w i t h special reference to t he provisions of and regulat ions made unde r th is Ac t , and any by-laws or regula t ions of the said au thor i ty re la t ing
to the publ ic hea l th . The local au thor i ty shall, at such t imes as may be prescribed, forward to t he board copies of all reports of a medical officer of hea l th made as aforesaid.
13. A medical officer of hea l th may a t any reasonable t imes
inspect t he register books of dea ths wi th in his district .
The Regis t ra r -Genera l and every district regis trar and ass is tant
dis t r ic t regis t rar unde r the Act n ine teenth Victoria n u m b e r th i r ty- four or any Ac t regu la t ing the regis t ra t ion of dea ths shall make or cause to be made a t the request of the medical officer of hea l th of t h e dis t r ic t such ex t rac ts from or copies of the said regis ter books as such officer
m a y requi re . Eve ry such registrar shall upon regis ter ing any death enter in his regis ter book par t iculars of the cause of death and t h e n a m e of t h e person cert ifying to such cause, and whe ther such person is a legally qualified medical pract i t ioner or not .
14. For the purpose of ca r ry ing in to effect t he provisions of this Act , a local au thor i ty or a medical officer of hea l th of the local au thor i ty , m a y en te r and examine any premises s i tuate wi th in t h e distr ict adminis tered by t h e said au tho r i t y be tween the hours of e ight o'clock of t he
forenoon and e ight o'clock of t he afternoon, or a t all hours du r ing
which business is in progress, or is usual ly carr ied on in t h e premises.
15. Eve ry local au thor i ty shall quar ter ly , or a t any t ime, a t
t he reques t of t he board, report in wr i t ing to t h e board as to ma t t e r s
re la t ing to t he publ ic hea l th and the adminis t ra t ion of this Ac t
wi th in the i r district .
16. W h e r e any power conferred by any s ta tu te , regulat ion, or
by- law on a n y local au thor i ty for t he preservat ion of t he publ ic hea l th (not be ing a power to m a k e regula t ions or by-laws) has in t h e opinion of t h e board not been duly exercised by the local au thor i ty , and t h e failure to exercise the power is in t h e opinion of the board l ikely to endanger t he publ ic hea l th , the board is hereby empowered, by not ice in wr i t ing signed by its president or secretary, to requi re t he local au thor i ty to exercise t h e power wi th in t he t ime ment ioned in t h e not ice .
If t he said r equ i rement is disobeyed or is no t complied with,
i t shall be lawful for the board to exercise t he power, and where t helocal au thor i ty is a munic ipa l council to recover from it t h e expenses
thereby incurred . 17.
17. I f a n y local au tho r i t y having the power conferred on it
by any s t a tu t e of m a k i n g regulat ions or by-laws for t he preservat ion of the publ ic heal th neglect , for th ree mon ths after not ice from t h e board signed by its pres ident or secretary has been given to the local au thor i ty , to m a k e such regula t ions or by-laws as aforesaid, i t shal l be lawful for t he Governor on t he recommendat ion of t he board to exercise t h e power conferred on the local au thor i ty as aforesaid.
18. If any local au thor i ty have m a d e regulat ions or by- laws for the preservat ion of t he publ ic hea l th which in t he opinion of t h e board are unsu i tab le or improper for t he purpose aforesaid, i t shal l be lawful for t he Governor , on t he recommendat ion of the hoard, to exercise any power conferred on the local au thor i ty of amend ing , a l ter ing, or repeal ing t he said regula t ions or by-laws.
19. W h e n any person deems himself aggrieved by any order of a local au thor i ty , or by any decision of a local au thor i ty in any case in wh ich the au tho r i t y is empowered to recover in a s u m m a r y m a n n e r a n y expenses incurred , and in which a mode of appeal is no t expressly provided by this Act , he m a y appeal aga ins t any such order or decision to a police or s t ipendiary magis t ra te or any two just ices s i t t ing as a cour t of pe t ty sessions wi th in t he district adminis tered by

Provided t h a t he state in wr i t ing to such Cour t t he grounds
of his complaint , and deliver a copy thereof to t he local au thor i ty
wi th in the t ime prescribed.
The said Cour t may make; such order in the m a t t e r as it may deem equi tab le , and the order so made shall be b ind ing and conclusive on all part ies .
Any proceedings commenced for the recovery of such expenses by the local au thor i ty shal l , on delivery to t h e m of such copy as afore said, be stayed ; and the Court may , if it- t h inks fit, by its order direct t he local au thor i ty to pay to the person so proceeded agains t such s u m as i t may consider to be a jus t compensat ion for the loss, damage, or grievance thereby sustained by h im.
PA11T I I I .
NOTIFICATION AND PREVENTION OF INFECTIOUS DISEASES.
Infect ious diseases.
20. The Governor may , by proclamat ion in t h e Gazette, dec lare
t h a t any disease the re in named is a n infectious d isease ; and he may , in t he m a n n e r aforesaid, revoke or vary any declarat ion made u n d e r
| th i s | section. |
Notification of infectious diseases.
2 1 . (I) W h e r e an i nma te of any house is suffering from an
infect ious disease t he following provisions shall have effect, t ha t is to
say :—
(a)
the head of the family to which such inmate (in this Act referred to as t he pat ient ) belongs, and in his default the neares t relat ive of the pa t i en t present in the house or being in a t t endance on the pa t ien t , and in default of such relat ive every person in charge of or in a t t endance on t h e pat ient , and in defaul t of any such person t h e occupier of t he house shall, as soon as he becomes aware t h a t t he pa t i en t
is suffering from an infectious disease, give notice in writing
thereof to the local au thor i ty of t he dis tr ic t . ( 6 )
(b) Eve ry medical pract i t ioner a t t e n d i n g on or called in to visi t t h e pa t i en t shal l for thwi th , on becoming aware t h a t t h e pa t ien t is suffering from an infectious disease, send to t h e local au thor i ty of t h e distr ict a certificate s ta t ing the n a m e of t h e pat ient , t h e si tuat ion of t h e house, and infectious disease from which, in the opinion of such medical prac t i t ioner , t h e pa t i en t is suffering, and such o ther par t icu la rs as m a y be prescribed.
(II) E v e r y person requi red by th is section to give a notice
or certificate who fails to give t he same shal l be liable to a pena l ty not
exceeding five p o u n d s : Provided t h a t if a person is no t requi red to give not ice in t he first ins tance , b u t only in defaul t of some other person, he shal l no t be liable to a n y pena l ty if he satisfies t he Cour t t h a t he had reasonable cause to suppose t h a t the notice had been duly given.
(III) The board shall gra tu i tous ly supply forms of certificate
to any local au thor i ty app ly ing for t he same for d is t r ibut ion among legally qualified medical pract i t ioners , and shall pay to every legally qualified medical pract i t ioner for each certificate duly sent by h i m in accordance wi th th is Ac t a fee of th ree shil l ings and sixpence.
22. The Regis t ra r -Genera l and every district regis t rar and
ass is tant dis tr ict regis t rar unde r t he A c t n ine teen th Victoria n u m b e r thir ty-four , or any Act r egu la t ing the regis t ra t ion of deaths , shal l immedia te ly after regis ter ing any dea th apparen t ly caused b y an infectious disease forward a notification of such dea th to t he secre tary to t h e board, giving the n a m e and residence of the deceased, age, cause of dea th , and t h e n a m e of t he person cert i fying to t he cause of death , and such o ther par t iculars as m a y be prescribed.
Precention of the spread of infectious diseases.
23. The two next following sections shall apply only to munic i
palit ies and to sani tary areas procla imed under subsect ion (II) of
section for ty-eight .
2 1 . (I) W h e r e a legally qualified medical pract i t ioner reports to t he local au thor i ty , or t he said au thor i ty is of opinion t h a t t he c leansing and disinfecting of any drains or of any house or pa r t thereof, and of any art icles there in l ikely to re ta in infection, or t he dest ruct ion of such art icles would t end to p reven t or check the spread of any infect ious disease, the local au thor i ty , and where the; said au tho r i t y
is a munic ipa l council , the mayor m a y serve a not ice on the occupier ,
or where the land, house, or pa r t thereof is unoccupiexl, on t h e ownerof such land, house 1, or pa r t thereof, t h a t t he drains or t h e house or p a r t thereof and any such art icles there in will be cleansed and disinfected or (as regards the articles) destroyed by t h e local au thor i ty , unless he; informs the local au thor i ty w i th in twenty- four hours from the receipt of t h e not ice t h a t he will cleanse and disinfect t h e drains or the house or p a r t thereof, and any such art icles, or destroy such art icles to the 1 satisfaction of a legally qualified medical pract i t ioner as certified b y h i m in wr i t ing to t he local au thor i ty , wi th in a t ime fixed in t he notice,
(II) I f e i ther—
(a)
within twenty-four hours from the receipt of the notice, the person on w h o m the notice is served does not inform the local au thor i ty as aforesaid ; or
(b)
having so informed the local authority he' fails to have the d ra ins ,house ,o rpa r t thereof and any such art icles disinfected or such art icles destroyed as aforesaid wi th in t h e t ime fixed in
t h e
(c) t he occupier or owner w i thou t such notice gives his consen t ;
theno t i ce ; or
t h e drains or t h e house or pa r t thereof and articles shall be cleansed and disinfected, or such art icles destroyed by t h e officers of the local author i ty , unde r t h e super in tendence of a legally qualified medical pract i t ioner , and t h e local au thor i ty may recover from the owner or occupier of t he house or pa r t thereof the cost of t he cleansing and disinfecting aforesaid. A n d failure to do the t h ings specified in subsect ion (6) wi th in t h e t ime ment ioned shall be deemed to be a b reach of t he provisions of th is Act . If f rom pover ty or other reason t h e person responsible is unable to carry out the requ i rements of t he local au thor i ty , t he la t ter may, w i th his consent , carry out t he necessary work a t the i r own expense.
(III) The local au tho r i t y shall provide, free of charge , t emporary shelter or house accommodat ion wi th any necessary a t t en dants for t h e m e m b e r s of any family in w h i c h any infectious disease has appeared who have been compelled to leave the i r dwell ings, for t h e purpose of enabl ing such dwellings to be disinfected by the local au thor i ty .
(IV) "When the local au thor i ty has disinfected any drains, house, p a r t of a house, or art icle u n d e r t h e provisions of th is section, it shall compensate t he owner of such drains, or the occupier or owner of such house, or pa r t of a house, or the owner of such article for any damage the reby caused to such drains, house, pa r t of a house , or art icle, and when the au tho r i t y destroys any ar t ic le unde r this section it shall compensa te t he owner thereof.
25. (I) The local au thor i ty or the medical officer of hea l th of the local au thor i ty , or a G o v e r n m e n t medical officer, may , by notice in wr i t ing , require t h e owner of any bedding, c lothing, or other ar t icles which have been exposed to t h e infection of a n y infectious disease, to cause t he same to be fo r thwi th delivered over to any person named in t h e not ice for removal for t he purpose of dest ruct ion or disinfection ; a n d a n y person who fails to comply wi th such a r equ i r emen t shall be liable to a pena l ty no t exceeding ten pounds .
The bedding, c lothing, and articles, if so disinfected by, or by direction of, t he local au thor i ty , shall be b rough t back and delivered to the owner free of charge , and if any of t h e m suffer any damage , the local au thor i ty shall compensate the Owner for t h e same ; and the said au thor i ty shal l also compensate the owner for any art icles destroyed.
(II) For t he purpose of car ry ing out t he provisions of this
section, a local au thor i ty or any local authori t ies by agreement among themselves shall provide a proper place (whether wi th in any of t he dis
| t r ic ts adminis tered b y the local au thor i t ies , or outside those distr icts) , |
w i th all necessary appara tus and a t tendance , for t he disinfection or des t ruc t ion of bedding, c lothing, and other a r t i c l e s ; b u t shall before
| e x p e n d i n g | any money for t h e purposes aforesaid | obta in the | approval |
| in wri t ing of the board as to the sui tabi l i ty of | t he said appara tus , and |
of the site of the place proposed to be provided as aforesaid.
(III) W h e n e v e r typhoid fever exists, t he local au thor i ty
m a y , a n d w h e n required by order of t he Board shall , provide a separate service for the removal and destruct ion by fire of t he excre ta of persons suffering f rom such fever.
26. (I) W h e r e a person ceases to occupy any house or pa r t of
a house in which any person has, wi th in six weeks previously, du r ing
his occupancy, been suffering from any infectious disease, and e i ther—
(a)
fails to have such house or part of a house and all articles there in l iable to re ta in infection disinfected to the satisfaction of a legally qualified medical pract i t ioner as testified by a
certificate signed by h im, or such art icles des t royed ; or (b)
fails to give to the Owner or occupier of such house or part of a house notice of t he previous existence of such disease,
he shall be l iable to a penal ty not exceeding five pounds .
(II)

of, o r b y a n y p e r s o n n e g o t i a t i n g for t h e h i r e of s u c h h o u s e or p a r t of a
h o u s e , a s t o t h e f a c t of t h e r e having w i t h i n s i x w e e k s p r e v i o u s l y d u r i n g
h i s o c c u p a n c y b e e n t h e r e i n a n y p e r s o n su f fe r ing f r o m a n y i n f e c t i o u s
d i s e a s e , h e k n o w i n g l y m a k e s a f a l s e a n s w e r t o s u c h q u e s t i o n , h e s h a l l
b e l i a b l e t o a p e n a l t y n o t e x c e e d i n g t e n p o u n d s .
(III) T h e l o c a l a u t h o r i t y s h a l l c a u s e t h e i r officers t o s e r v e
n o t i c e of t h e p r o v i s i o n s of t h i s s e c t i o n o n t h e o c c u p i e r of a n y h o u s e o r
p a r t of a h o u s e i n w h i c h t h e y a r e a w a r e t h a t t h e r e is a p e r s o n su f fe r ing
f r o m a n i n f e c t i o u s d i s e a s e .
27. A n y p e r s o n l e t t i n g fo r h i r e , o r s h o w i n g for t h e p u r p o s e of
l e t t i n g for h i r e , a n y h o u s e o r p a r t of a h o u s e i n w h i c h o r i n p a r t of w h i c h
w i t h i n h i s k n o w l e d g e t h e r e h a s b e e n w i t h i n t h e p r e v i o u s s i x w e e k s a
p e r s o n s u f f e r i n g f r o m a n i n f e c t i o u s d i s e a s e ( w h e t h e r t h e s a id h o u s e o r
p a r t of a h o u s e h a s o r h a s n o t b e e n d i s i n f e c t e d ) w h o fai ls t o s t a t e t h a t f a c t
t o t h e p e r s o n n e g o t i a t i n g for t h e h i r e of t h e h o u s e o r p a r t of a h o u s e ,
o r b e i n g s h o w n o v e r t h e h o u s e o r p a r t of a h o u s e fo r t h e a b o v e p u r p o s e , s h a l l b e l i a b l e t o a p e n a l t y n o t e x c e e d i n g t w e n t y p o u n d s .
28. A n y p e r s o n w h o k n o w i n g l y o r n e g l i g e n t l y s e n d s t o school
a c h i l d , w h o w i t h i n t h e p r e v i o u s t w o m o n t h s h a s b e e n s u f f e r i n g f rom a n i n f e c t i o u s d i s e a s e , o r w h o h a s b e e n r e s i d e n t i n a n y h o u s e i n w h i c h
s u c h d i sease h a s e x i s t e d w i t h i n t h e s p a c e of s i x w e e k s , w i t h o u t f u r n i s h i n g t h e h e a d t e a c h e r of t h e s c h o o l w i t h a c e r t i f i c a t e f r o m a
l e g a l l y q u a l i f i e d m e d i c a l p r a c t i t i o n e r t h a t s u c h c h i l d is f r e e f rom
d i s ea se a n d i n f e c t i o n , a n d c a u s i n g t h e c l o t h e s of s u c h c h i l d t o be
d i s i n f e c t e d t o t h e s a t i s f a c t i o n of a l e g a l l y qua l i f i ed m e d i c a l p r a c

29. I f i n t h e o p i n i o n of t h e b o a r d i t is d e s i r a b l e for t h e p u r p o s e
of p r e s e r v i n g t h e p u b l i c h e a l t h t h a t a n y s c h o o l o r c o l l e g e s h o u l d be
c losed , i t s h a l l b e l a w f u l fo r t h e b o a r d so t o n o t i f y i n t h e Gazette, a n d
b y n o t i c e s e r v e d o n t h e p r o p r i e t o r o r t r u s t e e s of t h e s c h o o l o r c o l l e g e .
O n t h e p u b l i c a t i o n of t h e n o t i c e i n t h e Gazette, t h e M i n i s t e r of t h e
C r o w n having c o n t r o l of a n y p u b l i c s c h o o l o r c o l l e g e t h e r e i n m e n t i o n e d ,
a n d t h e p r o p r i e t o r o r t r u s t e e s of a n y o t h e r s c h o o l o r c o l l e g e m e n t i o n e d a s a f o r e s a i d , s h a l l c a u s e t h e sa id s c h o o l or college; t o b e c losed a n d to b e k e p t c l o s e d u n t i l t h e b o a r d no t i f i e s i n t h e Gazette t h a t t h e schoo l

3 1 . Every owner, driver, or mas te r of a publ ic conveyance,
vehicle, or vessel, or, in t he case of conveyance by ra i lway, t he s tat ion- master , shall immediate ly cause such conveyance, vehicle , or vessel, after i t has to his knowledge conveyed any person suffering from a n infect ious disease to be disinfected to the satisfaction of the local a u t h o r i t y ; and if he fails to do so he shall be liable to a penal ty n o t exceeding five pounds .
E v e r y such owner, driver, master , or s ta t ion-master conveying,
or a l lowing to be conveyed, any person so suffering shal l be ent i t led to bo paid by the said person a s u m sufficient to cover any loss or expense which m a y be incur red or paid in c v r y i n g into effect t h e provisions of this section.
If—
(a) a person hires or uses a public conveyance other than a hearse for conveying t h e body of a person who has died from any infectious disease wi thou t previously notifying to t he owner or driver of t he conveyance tha t such person died from infectious disease ; or (&) t h e owner or driver does not , immedia te ly after the conveyance has to his knowledge been used for conveying such body, provide for t he disinfection of t he conveyance,
he shall be l iable to a line not exceeding five pounds, and if the offence cont inues to a fur ther line no t exceeding forty shill ings for every day

more t h a n th i r ty -s ix hours , t he body of any person who has died of a n y infectious disease wi th in a distr ict adminis tered by a munic ipa l council , or for more t h a n forty-eight hour s t he body of any person who has died of any infectious disease wi th in any other distr ict .
I t shall be t he du ty of t he occupier of t he bu i ld ing or place where t h e body is, and if the re be no occupier i t shall be t he du ty of the owner, to carry out t he provisions of this section, and on failure to do so he shall be liable to a pena l ty not exceeding fifty pounds .
33 . If any person dies from any infectious disease in any hospital or place of t empora ry accommodat ion for t h e sick, and any legally qual i fied medical pract i t ioner certifies t h a t in his opinion i t is desirable, in order to p reven t t he r isk of communica t i ng any infectious disease or of spreading infection, t h a t t he body should not he removed from such hospital or place, except for the purpose of be ing for thwi th bur ied or
cremated, it shall no t be lawful for any person to remove such body
from such hospital or place except for one of t he las t -ment ioned
pu rposes ; and when the body is t aken out of such hospital for t h a t purpose it shal l be fo r thwi th carried or t a k e n direct to some cemetery or place of bur ia l or crematory , and shall he for thwith the re bur ied or c r e m a t e d ; and any person wilfully offending against th is section shal l be liable to a pena l ty not exceeding t en pounds .
N o t h i n g in th is section shall prevent the removal of any dead body from any hospi ta l or t empora ry place of accommodat ion for t h e sick to any mor tuary , and such m o r t u a r y shall, for the purposes of this section, be deemed pa r t of such hospital or place as aforesaid.
3 1 . I t shall be lawful for a local au thor i ty , or for the t rus tees
of any burial g round or cemetery, to erect and ma in ta in crematories

Provided tha t the erection and. ma in tenance of the cremator ies ,
and all mat te rs in connect ion wi th the b u r n i n g of the dead, shall be
subject to such regula t ions as the Governor m a y m a k e in t h a t behalf.

COMMON L O D G I N G - H O U S E S .
35. A local au thor i ty m a y m a k e by-laws—
(a) providing for the registration and licensing of common lodging-houses ; a n d {b) fixing t h e n u m b e r of lodgers w h o m a y be received in to a
common lodging-house, a n d for recording the names of t he
lodgers, and for t he separat ion of the s exes ; and
(c)
prescribing the air space to be provided for each lodger, and the affixing; of notices as to t h e n u m b e r of lodgers to be
accommodated in each r o o m ; and (d) for enforcing cleanliness, drainage, and ventilation in such
houses ; a n d (e)
for giving of notices and taking precautions in the case of any infections disease ; and
( f )
for providing separate p r ivy accommodat ion for t he sexes ; and
(g)
generally for the orderly conduct and for providing for the sani tary condit ion of such lodging-houses.

B U I L D I N G V E A S A N D B U I L D I N G S .
36. Th i s p a r t shall apply only to districts adminis tered by
munic ipa l councils.
37. (I) W h e n t h e board, after caus ing due inqu i ry to be made ,
is of opinion tha t it would be prejudicial to hea l th t ha t any land should in i ts t h e n condit ion be bu i l t upon , t h e board m a y so repor t to t h e Minis ter , describing the land to which t h e report refers, and specifying the reasons which influence t h e board in coming to t h e opinion aforesaid, and the measures which are necessary to be t a k e n in order to render t h e land fit to be bui l t upon .
On receipt of t he report , it shall be lawful for t he Min is te r af ter caus ing such inquir ies and notifications as he m a y t h i n k fit to be
m a d e and given, by one notice in t h e Gazette, a n d by notices in three consecut ive issues of some newspaper c i rcula t ing in t he d is t r ic t in which t h e land is s i tuate , or by not ice served on t h e owner of t he land to declare t h a t t he l and shall no t be bu i l t upon u n t i l t h e measures referred to in t he notice and more par t icular ly specified in a document deposited in t h e office of t h e local au thor i ty and open to t h e inspection of a n y person have been t a k e n or t h e notice is revoked by the Minister .
I f any person in con t raven t ion of t h e not ice aforesaid bui lds
upon t h e land, he shal l be liable to a pena l ty not exceeding five pounds for every day t h a t bu i ld ing operations are carried on in contra
ven t ion of t h e
not ice . (II) F o r t he purpose of t he respective inquir ies aforesaid,
any person author ised by the Min is te r or t h e board in t h a t behalf m a y enter any land and die; holes the re in and remove the soil thereof. 38. (I) I t shall be the du ty of every local au thor i ty to cause to be made , from t ime to t ime, inspection of the i r distr ict , wi th a view to ascertain whe the r a n y dwell ing-house the re in is in a s ta te so injurious to heal th as to be unfit for h u m a n hab i ta t ion ; and if on t h e representa t ion of the i r medical officer of hea l th , or on informat ion
given,
given, any dwell ing-house appears to t h e m to he in such s ta te , to t ake proceedings agains t t h e owner or occupier for closing t h e house unde r the provisions of th is Act .
F o r the purpose of such inspection the local au thor i ty m a y open any ground a n d remove any flooring, and t a k e such measures as may be deemed necessary to ascer tain t he construct ion and condition of t h e dwell ing-house, and all pipes, drains, and fitt ings in connect ion the rewi th .
(II) Before t a k i n g such proceedings, t he local au thor i ty
shall serve; on t he owner or occupier a notice requi r ing h im to render t he dwell ing-house fit for h u m a n habi ta t ion, and specifying w h a t works are necessary to be done for t h a t pu rpose :
Provided t h a t where t h e s ta te of the house is caused by the w a n t or detect ive construct ion of any s t ruc tu ra l convenience, or t h e insani tary construct ion of t he house or of any par t thereof, or where there is no occupier of t he house, the not ice shall be served on the owner.
(III) I f wi th in fifteen days after service of t h e not ice in the preceding subsection ment ioned, no a r r angemen t s for satisfying the r equ i r emen t s of the local au thor i ty shal l have been agreed to, proceedings shall be commenced by a compla in t to a jus t ice by t h e local au thor i ty , or by any person author ised by the local au thor i ty in t h a t behalf, and the jus t ice shal l t he reupon issue a summons requ i r ing t he owner or occupier to appear before a police; or s t ipendiary magis t r a t e or any two just ices in pe t ty sessions who shall proceed to inqui re

(IV) A n y such proceedings m a y be t aken for t he purpose of caus ing the dwel l ing-house to be closed, w h e t h e r t he same is occupied or not ; and upon such proceedings t he magis t ra te or jus t ices may impose a pena l ty no t exceeding twen ty pounds, and m a k e a closing order.
(v) W h e r e a closing order has been made in respect of a
dwell ing-house, t he local au thor i ty shall serve a notice of t he order on
every occupying t enan t of t he h o u s e ; and wi th in such period as is
specified in t h e notice, not be ing less t h a n seven days after t he service
of t he not ice, t h e order shall be obeyed by h im, and he and his family
shal l cease to i nhab i t t he house, and in defaul t he shall be liable to a pena l ty not exceeding twen ty shill ings a day du r ing his disobedience

t e n a n t such reasonable al lowance on account of his expenses in removing as m a y have been authorised by the magis t ra te or just ices m a k i n g the closing order, which au thor i ty the magis t r a t e or just ices are he reby authorised to give, and the a m o u n t of t h e said al lowance shall be a civil debt due from the owner of the house to t h e local au thor i ty , and m a y be recovered in any court of competent jur isdic t ion.
39. (I) W h e r e a closing order has been made in respect of any dwell ing-house a n d has no t been de termined by a subsequent order, t h e n the local au thor i ty , if of opinion tha t t h e house has not been rendered lit for h u m a n habi ta t ion , and. t h a t the necessary steps are no t be ing t aken to render i t so fit, and t h a t t he cont inuance of t h e house or a n y par t thereof is dangerous to t h e hea l th of t he publ ic or of the inhab i tan t s of the ne ighbour ing dwelling-houses, shall pass a resolut ion t h a t i t is expedient to order t h e demoli t ion of t h e house or t h e said

(II) The local a u t h o r i t y shal l cause not ice of such resolut ion to he served on the owner of t h e house, and such notice shall specify t h e t ime and place appointed by t h e local au tho r i t y for t h e fu r the r considera t ion of t h e resolution, not be ing less t h a n one m o n t h af te r the service of the notice, and any owner of t h e house shall be a t l iber ty
to a t t end and s ta te his objections to t h e demolit ion.
(III) If, u p o n considerat ion of t he resolut ion and objections,
t h e local au tho r i t y decide t h a t it is expedient so to do, then , unless an owner under t akes to execute fo r thwi th t h e works necessary to render
t h e house l i t for h u m a n habi ta t ion , t he local au tho r i t y shall order t he demoli t ion of t he house or t h e said part thereof.
(IV) If an owner unde r t akes as aforesaid to execute t he said
works , t h e local au tho r i t y m a y order t he execut ion of t he works w i th in such reasonable t ime as is specified in t h e order, and if t he works v e not completed wi th in t he t ime or a n y ex tended t ime allowed by t h e local au thor i ty or t he magis t r a t e or just ices aforesaid, t he local au tho r i t y shall order t h e demoli t ion of t h e house or t he said part thereof.
40. (I) W h e r e an order for t h e demoli t ion of a house or any part thereof has been made , t he owner thereof shall , wi th in th ree mon ths after service of t he order, proceed to t ake down and remove; the house or t he part thereof, and if the owner fails there in , t h e local au tho r i t y shal l proceed at his risk and expense to t ake down and remove t h e same and shall sell t h e mater ia ls , and after deduc t ing the expenses incident to such t ak ing down and removal a n d sale, pay over t he balance (if any) to t he owner. If such proceeds do not cover t h e expense t he amoun t of t he deficiency m a y be recovered by t h e local au tho r i t y from t h e owner in any court of competen t jur isdict ion.
(II) W h e r e a house or part thereof has been so t aken down a n d removed, no house or o ther bui ld ing or erection which will be dangerous or injurious to hea l th shal l be erected on all or any part of t h e site of such house or part thereof ; and if any house, bui lding, or erect ion is erected contrary to the provisions of th is section, t he local au thor i ty m a y at any t ime order t he owner thereof to abate t he same, and in t he event of non-compliance wi th t he order may , a t t he expense of the owner, aba te or a l te r t h e same.
4 1 . (I) A n y person aggrieved by an order of a local au thor i ty
u n d e r this part of the A c t m a y appeal aga ins t t he same to t he n e x t
Cour t of Qua r t e r Sessions holden wi th in the d i s t r i c t ; and t h e pro
visions of t he Cr iminal L a w A m e n d m e n t A c t of 18S3 re la t ing to appeals
to Qua r t e r Sessions from summary convictions shall app ly wi th the necessary modifications as if t he order of the local au tho r i t y were a summary conviction unde r t h e said Act .
( 1 1 ) Provided that—•
(a) notice of appeal may be given within one month after notice of t he order of t he local au thor i ty has been served on such
pe r son ; and (b)
t h e Court of Q u a r t e r Sessions shall , a t t he reques t of e i ther party, s ta te t he facts specially for t he de terminat ion of t h e Supreme Court , in which case t he proceedings m a y be
removed in to t h a t Court .

NUISANCES.
42. (I) F o r the purposes of this A c t —
(«) any premises inc lud ing those owned by the Governmen t or by publ ic bodies in such a s ta te as to be a nuisance, or injurious or dangerous to hea l th ;
(b) any pool, di tch, gu t t e r , watercourse , cistern, water-closet , ear th-closet , pr ivy, u r ina l , cesspool, cesspit, drain , dung-p i t , or ash-pi t , so foul or in such a s ta te as to be a nu isance or injurious or dangerous to heal th ;
(c) any accumula t ion or deposit which is a nu isance or in jur ious or dangerous to hea l th ;
(d) any factory, workshop, or workplace which is not under flic
operat ion of a n y general A c t for t he regula t ion of fac tor ies ; and
(I) is no t kept in a cleanly state and free from effluvia v i s i n g
from any or other nuisance ; or drain, privy, water-closet , earth-closet, u r ina l , (ii) is no t vent i la ted in such a m a n n e r as to render harmless , so far as pract icable , any gases, vapours , dust , or other impuri t ies generated in t h e course of t he work carr ied on there in , t h a t are a nuisance or injur ious or dangerous to hea l th ,
shall be nuisances liable to be dealt wi th summar i ly under th is Act .
(II) Provided tha t any accumula t ion or deposit necessary
for the effectual car ry ing on of any business or manufac tu re shall n o t be liable to be dealt wi th summar i ly under th is Act , if i t is proved to t h e satisfaction of t he magis t ra te or just ices hereinafter referred to t h a t t h e accumula t ion or deposit has not been k e p t longer t h a n is necessary for t he purposes of t he business or manufac tu re , and tha t the best w a i l able means have been t aken for p reven t ing in jury the reby to the publ ic hea l th .
(III) Provided also t h a t in t he case of premises owned by the
Governmen t or any publ ic body, t he officer having the chief control of such premises shall be liable for any breach of t he provisions of this part as if he were t h e ac tua l owner or occupier of such premises, b u t if such person proves t h a t the breach was one for which he should

| 4 3 . (1) On t h e receipt of any informat ion respect ing t he exis tence of a nuisance liable to be dealt with summarily unde r th is Ac t , the local au thor i ty shall, if satisfied of the existence of the nu isance , serve a notice on the person by whose act, default , or sufferance t he nuisance v i s e s or cont inues , or if such person canno t be found, on t he occupier or owner of t he premises on which the nu isance v i s e s , requ i r ing h im to abate t he same wi th in t he t ime specified in t he not ice, and to execute such works and do such th ings as may be necessary for t h a t purpose, and if t he local au thor i ty t h ink i t desirable (but not otherwise) specifying any works to be executed. | |
| (II) The local au thor i ty may also by the same or ano ther not ice served on such occupier, owner, or person, requi re h im to do w h a t is necessary for p reven t ing the recur rence of the nuisance , and if they t h i n k i t desirable specify any works to be executed for t h a t purpose, and may serve t h a t notice no twi ths t and ing tha t the nu isance m a y for t he t ime have been abated, if the local au thor i ty consider tha t it is l ikely to recur on the same premises. |
M (III)
(III) Provided t h a t —
(a) where the nuisance vises from any want or defect of a
s t ruc tu ra l character , or where t h e premises are unoccupied , t h e not ice shall he served on the owner ; and
(b) when ; t he person caus ing t h e nuisance cannot be found, a n d i t is clear t h a t t he nuisance does not v i s e or cont inue by the act , default , or sufferance of t h e occupier or owner of t he premises , the local au thor i ty m a y themselves aba te the same, and m a y do wha t is necessary to prevent the recur rence thereof.
44. (I) I f e i the r— («) t he person on w h o m a notice to abate a nuisance has been served as aforesaid makes default in comply ing wi th a n y of t he requisi t ions thereof wi th in t he t ime specified ; or
(b) t he nu isance , a l though abated since the service of the notice, is, in t he opinion of t he local au thor i ty , l ikely to recur on
t h e same p remises ;
the local au thor i ty shal l m a k e compla in t to a just ice , and such jus t ice shall t he reupon issue a summons requ i r ing t he person on whom the
not ice was served to appear before a police or s t ipendiary mag i s t r a t e , or any two jus t ices in pe t ty sessions.
( I T ) The said magis t r a t e or just ices may , if satisfied t h a t
t he alleged nuisance exists, or tha t a l though abated i t is l ikely to recur on the same premises, by order requi re the said person to comply wi th all or any of the requisi t ions of t h e notice, or otherwise to abate the nuisance wi th in a t ime specified in t he order, and may, if t h o u g h t desirable, specify the works to be executed by the said person for the
purpose of aba t ing or p reven t ing the recur rence of t he nu isance . (III) If a person fails to comply wi th an order of a magis t ra te or justices made as aforesaid, w i th respect to the aba t emen t of a nuisance , he shall, unless he satisfies t he Court t h a t he has used all due dil igence to car ry out such order, be l iable to a penal ty no t exceeding twen ty shill ings a day du r ing his de f au l t ; and if a person knowing ly and wilfully acts cont rary to a n order prohib i t ing t h e recur rence of a nuisance, he shall be liable to a pena l ty no t exceeding forty shillings a day dur ing such cont rary ac t ion : Moreover, t h e local au tho r i t y m a y enter the premises to which an order made unde r th is part relates, and abate or remove the nuisance, and do wha tever m a y be necessary in execut ion of such order.
45 . W h e n e v e r it appears to t h e magis t ra te or just ices t ha t the
person by whose act, default , or sufferance a nuisance l iable to be deal t wi th summarily under th i s A c t arises, or t he owner or occupier of t h e premises is not known or cannot be found, then t h e order m a y be addressed to, and if so addressed shall be executed by, t he local au tho r i t y .
46 . A n y m a t t e r or t h i n g removed by the local au thor i ty in
aba t ing or do ing w h a t is necessary to p reven t the recurrence of a nuisance liable to be deal t wi th summarily unde r th is Ac t may be sold or disposed of w i thou t sale, and the money v i s i n g from t h e sale m a y be re ta ined by the local au thor i ty and applied in paymen t of the expenses incurred by t h e m in reference to such nuisanee, a n d t h e surplus (if any) shal l he paid, on demand, to the owner of such m a t t e r
or t h ing .
4 7 . ( 1 ) A n y person aggrieved by the order of a mag i s t r a t e or
just ices unde r th is part prohibi t ing the recurrence of a nuisance or r equ i r ing t he execution of s t ruc tu ra l works may appeal against the
same to t he n e x t Cour t of Quarter Sessions holden wi th in the d is t r ic t ;
and t h e provisions of the Cr imina l Law A m e n d m e n t Ac t of 1883
re la t ing
re la t ing to appeals to Quarter Sessions from summary convict ions shall app ly wi th t he necessary modifications as if the order aforesaid were a summary conviction under the said Act .
( IT) W h e r e a person appeals as aforesaid, no l iabil i ty to a
pena l ty shall v i s e , nor shall any proceedings be t a k e n or work be done unde r the order of the magis t ra te or just ices un t i l af ter t he de te rmina t ion of such appeal , unless such appeal ceases to be prosecuted.
48. (I) The Governor may, by proclamat ion in the Gazelle,
declare the whole or any port ion of a munic ipa l i ty to be a sani tary area, and revoke and vary any proclamation made as aforesaid. II shall thereupon he the d u t y of the council of the munic ipa l i ty to m a k e by-laws prohib i t ing unde r suitable penalties t he const ruct ion or use of cesspits and the bur ia l of night-soil wi th in t he said area, and for the regula t ion of t he deposit of house refuse, rubbish, and. garbage, and for the des t ruct ion thereof, providing for the filling-up of disused cesspits, and for t he disposal of night-soil .
(II) By l ike proc lamat ions t he Governor may cons t i tu te
s a n i t v y areas in populous localities s i tuate outside any munic ipa l i ty , and may define the boundaries of t he same, and may revoke and vary any proclamation made as aforesaid. The board m a y the reupon m a k e regula t ions for the purposes ment ioned in subsection (I) to have effect within the areas so const i tu ted .
PART V I I . POLLUTED WATER SUPPLY.
40. (I) W h e r e a Government medical officer, or an officer of hea l th or two legally qualified medical pract i t ioners certify to a local au tho r i t y t h a t any well, dam, t ank , s t ream, or o ther source of water supply for d r ink ing or domestic purposes is so pol luted or unwholesome as to be unfit for those purposes, the local au tho r i t y may , with t he consent of t he board, by notification in t he Gazelle and in two con secutive issues of some newspaper c i rcula t ing in the place where t he well, dam, t ank , s tream, or source of water supply is s i tuate , direct tha t w i th in a t ime there in ment ioned the well, dam, t ank , or other similar source of water supply shall be closed by the owner of t he same, and t h a t the water in or flowing from the well, dam, t ank , s tream, or o ther

| revoking the direction aforesaid. |
A n d t h e board or t h e local au thor i ty may a t any t ime between the hours of ten of t he clock in t he forenoon and six o'clock in the af ternoon enter upon a n y premises wi thin t h e distr ict of such au thor i ty for the purpose of obta in ing a sample of any water .
A n y person who fails to comply with any direction notified as aforesaid, or who uses or causes to be used for any of the purposes aforesaid any wa te r in or flowing from such well, dam, t ank , s t ream, or other source of water supply as aforesaid while such direction remains in force shall be liable to a penal ty not exceeding five pounds for each day dur ing which the direction is no t complied with, or tie well, dam, t ank , s t ream, or other source of water supply is so used as aforesaid.
(II) W h e r e any case; of infectious disease exists in a dis tr ic t , and the board or the president has reason to suspect tha t the said disease has been caused by or m i g h t be spread by water contained in any well, dam, t ank , or other similar source' of water supply, the
