Public Finance and Audit Amendment

Regulation 2011

under the

Public Finance and Audit Act 1983

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Public Finance and Audit Act 1983.

Explanatory note
The objects of this Regulation are:

(a)

to amend the Public Finance and Audit Act 1983 (the Act):

(i)	to remove a reference to the New South Wales Commercial Fishing Advisory Council from the list of statutory bodies that are subject to Division 3 (General audit of statutory bodies) of Part 3 (Audit) of the Act to reflect the abolition of that body, and
(ii)	to remove a reference to the Office of the Information Commissioner from the list of Departments that are subject to Division 4A (General audit of Departments) of Part 3 (Audit) of the Act to reflect the replacement of that body with the Information and Privacy Commission (which is already referred to in that list), and

(b)

to amend the Public Finance and Audit Regulation 2010 (the Regulation):

(i)	to remove references to UNILINC Limited and the NSW Treasury Managed Fund from the list of statutory bodies, funds and accounts that are subject to particular audits under Division 4 (Particular audit of statutory bodies, funds and accounts) of Part 3 (Audit) of the Act, and
(ii)	to insert a reference to the Home Warranty Insurance Fund into that list.

This Regulation is made under the Public Finance and Audit Act 1983, including sections 40 (2), 44, 45B (3) and 64 (the general regulation-making power).

1 Name of Regulation

This Regulation is the Public Finance and Audit Amendment
Regulation 2011.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Public Finance and Audit Act 1983 No 152

(1) Schedule 2 Statutory bodies

Omit “New South Wales Commercial Fishing Advisory Council”.

(2)	Schedule 3 Departments
Omit the matter relating to the Office of the Information Commissioner from Columns 1 and 2.

4 Amendment of Public Finance and Audit Regulation 2010

(1) Schedule 1 Prescribed audits

Omit item 31 in Part 1.

(2)	Schedule 1, Part 2
Omit item 39. Insert instead:
39 Home Warranty Insurance Fund
