PUBLIC FINANCE AND AUDIT ACT 1983 - REGULATION

(Relating to prescription of certain persons

as officers of authorities) NEW SOUTH WALES

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Public Finance and Audit Act 1983, has been pleased to make the Regulation set forth hereunder.

The Public Finance and Audit Regulation 1984 is amended by

inserting after clause 2AA (2) the following subclause:

(3) For the purposes of paragraph (d) of the definition of "officer of an authority" in section 4 (1) of the Act, a person specified in Column 2 of the Table to this subclause is a prescribed person in relation to the authority specified opposite the person in Column 1 of the Table:

EXPLANATORY NOTE

The object of this Regulation is to amend the Public Finance and Audit Regulation 1984 to prescribe certain persons other than actual employees of the authorities as officers of authorities. The Regulation will ensure that sections 9 (Treasurer’s directions), 12 (Commitment of expenditure) and 13 (Payment of accounts) of the Public Finance and Audit Act 1983 will apply to those persons when they are carrying out financial functions on behalf of the relevant authorities.
