Amendments made to the Suitor’s Fund Act 1951 by the Courts Legislation te Further Amendment Act 1997 provided that the Director-General of the Attorney General’s Department is to be the corporation sole constituted under the 1951 Act (previously, the Director-General of the Department of Courts Administration was to be construed as the corporation sole). The Courts Legislation Further Amendment Act 1998 amended the 1951 Act to provide that the Suitor’s Fund is no longer to be a separate account in the Special Deposits Account in the Treasury but is instead to form part of the Attorney General’s Department Account. The object of this Regulation is to remove the reference in Schedule 2 to the Public Finance and Audit Act 1983 to the corporation sole constituted under the Suitors’ Fund Act 1951 so that the corporation sole will no longer be required to keep accounting records, and be audited, under the 1983 Act in addition to the Attorney General’s Department. This Regulation is made under section 40 (2) of the Public Finance and
Audit Act 1983.
