His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Public Finance and Audit Act 1983.

The object of this Regulation is to prescribe public servants employed in the Department of Housing, and certain officers of the Central Corporate Services Unit in the Department of Public Works and Services, as officers of the Aboriginal Housing Office for the purposes of exercising functions under the Public Finance and Audit Act 1983 relating to the committing or incurring of expenditure and the authorising of payment of accounts. (Section 97 of the Public Sector Management Act 1988 provides, among other things, that a reference in any instrument to a “public servant” is to be read as a reference to an officer or temporary employee within the meaning
of that Act.)
This Regulation is made under the Public Finance and Audit Act 1983, and, in particular, under sections 4 (the definition of officer of an authority) and
64 (the general regulation-making power).

2 Amendment of ublic Finance and Audit (General)

1995

The Public Finance and Audit (General) Regulation 1995 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

(Clause 2)

  1. Clause 17 Definitions of “authority” an of an authority”

Insert “Aboriginal Housing Office” under “Department of
Aboriginal Affairs” in Part B of the Table to clause 17 (4).
] Clause 1 7 (5)
Insert after clause 17 (4):
(5) For the purposes of the definition of officer of an authority in section 4 (1) of the Act, a public servant employed in the Department of Housing is a prescribed person (in addition to the persons referred to in subclause
(4)) in relation to the Aboriginal Housing Office, but
only for the purposes of exercising functions under
sections 12 and 13 of the Act.
