An Act to substitute section 4 of the Public Defenders Act, 1969, as a consequence of the enactment of the Legal Services Commission Act, 1979. [Assented to, 16th May, 1979.1

Public Defenders {Legal Services Commission) Amendment.
BE it enacted by the Queen’s Most Excellent Majesty, by and with
the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—
1. This Act may be cited as the “Public Defenders (Legal short title.
Services Commission) Amendment Act, 1979”.
2. (1) Except as provided in subsection (2), this Act shall Commence-
commence on the date of assent to this Act.
(2) Section 3 shall commence on the day appointed and notified under section 2 (3) of the Legal Services Commission Act, 1979.
3. The Public Defenders Act, 1969, is amended by omitting
| section 4 and by inserting instead the following section :— | 60, 1969. Sec. 4. |
4. (1) In this section, “Commission” means the Legal Legal aid.
Services Commission of New South Wales constituted under the Legal Services Commission Act, 1979.
| (2) | A Public Defender may appear for a person who, as |
a consequence of—
| (a) | being charged with the commission of, or desiring to appeal against his conviction or sentence for, any indictable offence or any other offence specified or of a class specified by the Commission; or |
| (b) | being committed for trial or sentence for an indictable offence. |

Commission Act, 1979.

(3) A Public Defender may, when appearing for a person under subsection (2), be instructed by a solicitor who is an officer of the Commission or by another solicitor.
