Principal Act the words" that a certificate of registration of the vehicle under *"The Main Roads Acts, 1920 to 1943," and the regulations thereunder is in force" are repealed and the words" that the vehicle is appropriately registered in accordance with the provisions of *"The Main Roads Acts, 1920 to 1943," and the regulations thereunder" are inserted in lieu of such repealed words. [ASSENTED TO 3RD OCTOBER, 1947.] B E it enacted by the King's Most Excellent Majesty~ by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - Short title l. This Act may be cited as " The Public Ourator and . Acts Amendment Act of 1947," and shall be read as one constructIOn. with t" The Public Ourator Acts, 1915 to 1945," herein referred to as the Principal Act. Collective The Principal Act and this Act may be collectively title. cited as " The Public Ourator Acts, 1915 to 1947." Amendments of the Principal Act. Amendment 2. The second paragraph of subsection one of of s. 9 (1). section nine of the Principal Act is repealed and the following paragraph is inserted in lieu thereof, namely:- " The public curator shall be capable in law of suing and being sued, and of taking, purchasing, holding, alienating, conveying and otherwise dealing with real and personal, moveable and immoveable property within and outside the State of Queensland, and of doing and suffering all such other acts and things as bodies cor- porate may by law do and suffer." * 10 G. 5 No. 26 and amending Acts. t 6 G. 5 No. 14 and amending Acts.
TRUSTEES AND EXECUTORS. 311 1947. Public Cumtor Acts Amendment Lict. 3. The following section is inserted after section New s. 28A twenty-eight of the Principal Act, namely :- inserted. " [28A.] (1.) (a) If in the opinion of the Governor in Public Council it is expedient that any real or personal moveable ~ur~tor may or immoveable property within or outside the State of p~ operty as Queensland which is wholly or partly used or which t~ ns~ e for it is proposed shall be wholly or partly used by the t e rown. Government of the State of Queensland for govern- mental administrative or departmental purposes shall be held by the public curator for and on behalf of His Majesty the King in right of the State of Queensland, the Governor in Council may, by Order in Council, authorise and direct the public curator to purchase, accept, hold or take such property to be held unto and to the use of the public curator upon trust for His Majesty the King His Heirs and Successors in right of the said State. (b) The public curator shall hold and deal with any such real or personal moveable or immoveable property at all times in accordance with such authorities and directions as may be given to him by the Governor in Council. . The Governor in Council may give to the public curator such authorities and directions to purchase accept hold and deal with such property as in the circumstances he shall think fit. The Governor in Council may give to the public curator either general directions as to the manner in which he shall exercise his powers and perform his duties as trustee in relation to any class or classes of matters or property or specific dire~ tions as to the manner in which he shall exercise his powers or perform his duties in respect of any particular matter or property. It shall not be necessary for the public curator to take· or hold any such property outside the State of Queensland in or by any name, style, title, or description other than "The Public Curator of Queensland." (2.) Land in this subsection shall mean any Crown land in Queensland which is at any time after the passing of *', The Public Curator Acts Amendment Act of 1947" held or used by His Majesty the King' for governmental administrative or departmental purposes but does not include any land held under a lease or license from the Crown or any other Crown lands. * This Aot,

If in the opinion of the Governor in Council it is desirable that the legal estate in any such land shall be held by the public curator the Governor in Council may grant in fee-simple such land to the public curator to be held unto and to the use of the public curator upon the trusts set forth in this section and issue the deed of grant thereof in the name of the public curator as trustee under this section. (3.) Any person desirous of ~ urrendering to the Crown any freehold land in Queensland under *"The Real Property Acts, 1861 to 1942," may, with the approval of the Governor in Council, in lieu of transferring the same to His Majesty the King transfer such land unto and to the use of the public curator upon the trusts set forth in this section by executing a memorandum of transfer in any form substituted for Form" D" in the Schedules to *" The Real Property Acts, 1861 to 1942," contained· in favour of the public curator as trustee under this section. Any freehold land in Queensland under *" The Real Property Acts, 1861 to 1942," accepted or taken by the public curator pursuant to the provisions of subsection one of this section shall be transferred to him in like manner and held by him as trustee under this section. (4.) The public curator may execute all such deeds conveyances assurances transfers documents and other writings as may be necessary or expedient for the due execution by him of any trust declared by this section and no person dealing with him in relation to the execution of any such trust shall be bound to enquire whether he is acting in the proper execution of his power hereunder. (5.) When acting as trustee under this section the public curator shall represent the Crown and shall be a Crown instrumentality and shall have and mayexerciseall the powers privileges rights and remedies of the Crown." * 25 v.
