Public Authorities Superannuation (Government Initiatives Transfer) (Savings and Transitional) Regulation 1986 (NSW)

1Name of Regulation

This Regulation may be cited as the Public Authorities Superannuation (Government Initiatives Transfer) (Savings and Transitional) Regulation 1986.

2Definition

In this Regulation:

the Act means the Public Authorities Superannuation Act 1985.

3Schedule 9 to apply to transfer of certain Council gas employees(1)

The transfer of employment of a contributor or former contributor employed solely or predominantly in the production, sale or distribution of gas, whether or not reticulated, or in management activities connected with that production, sale or distribution, being a transfer of employment from a Council to A.G.L. Western Limited effected by way of acceptance of an offer of employment made by that company to the contributor or former contributor by a letter dated 2 December 1985, is a transfer of employment to which Schedule 9 to the Act applies.

In subclause (1):

Council means the Council of the City of Bathurst, the Council of the City of Orange or the Council of the City of Greater Lithgow.

4Special provisions relating to certain contributors

A transferred contributor to whom Schedule 9 to the Act applies who is a participant in a superannuation scheme referred to in clause 1 (1) of Schedule 8 to the Act shall be transferred from that superannuation scheme to the superannuation scheme constituted by the Act and shall have such rights and obligations in relation to the superannuation scheme constituted by the Act as are determined by the Board.
