Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Public Authorities (Financial Arrangements) Act 1987.

Explanatory note

The object of this Regulation is to confer additional investments powers on the Cancer including clause 2 (c) of Schedule 4 and section 43 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Public Authorities (Financial Arrangements)
Amendment (Cancer Institute) Regulation 2005.

2 Amendment of Public Authorities (Financial Arrangements) Regulation 2000

The Public Authorities (Financial Arrangements) Regulation 2000 is amended as set out in Schedule 1.

Schedule 1 Amendment

(Clause 2)

Clause 52P

Insert after clause 52O:

52P Additional investment powers—Cancer Institute (NSW)

The following additional investments are prescribed in respect of the Cancer Institute (NSW) (the Institute) for the purposes of clause 2 (c) of Schedule 4 to the Act:

(a)

any investment in a unit trust scheme within the meaning of the Duties Act 1997,

(b)

in the case of funds of or under the control of the Institute comprising property the subject of a gift, devise or bequest to the Institute—investment in such manner as will enable the property to be retained by the Institute in the form that the property was gifted, devised or bequeathed,

(c)

investment in such manner as may be necessary to enable the Institute to act as provided by section 16 (3) of the Cancer Institute (NSW) Act 2003.
