Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Public Authorities (Financial Arrangements) Act 1987.

Explanatory note
The object of this Regulation is to authorise certain investments to be made by Anabranch Water (which is a private irrigation board of management constituted under section 148 of the Water Management Act 2000).

This Regulation is made under the Public Authorities (Financial Arrangements) Act 1987, including paragraph (e) of the definition of authority in section 3 (1), section 43 (the general regulation-making power) and clause 2 (c) of Schedule 4.

1      Name of Regulation

This Regulation is the Public Authorities (Financial Arrangements)
Amendment (Anabranch Water) Regulation 2009.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

[1]      Schedule 1 Definitions of “authority” and “controlled entity”

Insert in alphabetical order in Part 1 of the Schedule:

Anabranch Water (being the board of management for the Great Anabranch of the Darling River Private Water Supply and Irrigation District, constituted by a proclamation published in Gazette No 142 of 25 November 2005 at pages 9809–9810), but only for the purposes of Part 3 of the Act

[2]      Schedule 5 Authorities having additional investment powers

Insert after clause 2 of Part 1 of the Schedule:

3      Anabranch Water

(1)  The following additional investments are prescribed in respect of Anabranch Water, but only if the investments are made on the advice of an appropriately licensed financial adviser and are made in connection with the Great Darling Anabranch pipelined water supply system:

(a)	direct or indirect investments in shares, property or fixed interest securities,
(b)	investments in cash management trusts.

(2) In this clause, Anabranch Water means the board of management for the Great Anabranch of the Darling River Private Water Supply and Irrigation District, constituted by a proclamation published in Gazette No 142 of 25 November 2005 at pages 9809–9810.
