His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Public Authorities (Financial Arrangements) Act 1987.

Explanatory note
The object of this Regulation is to declare that the Minister for Land and Water Conservation, being the Minister administering the Tweed River Entrance Sand Bypassing Act 1995 (the Bypassing Act), is an authority for the purposes of Part 2 of the Public Authorities (Financial Arrangements) Act 1987, but only for the purposes of functions exercised in connection with the Bypassing Act.

Part 2 of the Public Authorities (Financial Arrangements) Act 1987 deals with the way in which authorities may, for the purpose of exercising their functions, and in accordance with the written approval of the Treasurer, obtain financial accommodation.

This Regulation is made under the Public Authorities (Financial Arrangements) Act

1987, including sections 6 and 43 (the general regulation-making power).

1     Name of Regulation

This Regulation is the Public Authorities (Financial Arrangements) Amendment (Tweed River Entrance Sand Bypassing) Regulation 1999.

2 Amendment of Public Authorities (Financial Arrangements) Regulation 1995

The Public Authorities (Financial Arrangements) Regulation 1995 is amended as set out in Schedule 1.

Insert at the end of clause 56:

(2) However, a declaration of an authority in accordance with subclause (1) and Schedule 5 is subject to any limitation in relation to that authority specified in Schedule 5.
