Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Public Authorities (Financial Arrangements) Act 1987.

Explanatory note
The object of this Regulation is to exclude the New South Wales Grains Board from the definition of authority for the purposes of Part 2C of the Public Authorities (Financial Arrangements) Act 1987, which regulates guarantees. As a result, the repayment of certain financial accommodation obtained by the New South Wales Grains Board will not be subject to a Government guarantee under Part 2C.

This Regulation is made under the Public Authorities (Financial Arrangements) Act 1987, including the definition of authority in section 3 (1), section 3 (4) and section 43 (the general regulation-making power).

1. Name of Regulation

   This Regulation is the Public Authorities (Financial Arrangements) Amendment (New South Wales Grains Board Further Financial Accommodation) Regulation 2001.

2 Amendment of Public Authorities (Financial Arrangements)

Regulation 2000

The Public Authorities (Financial Arrangements) Regulation 2000 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

1. Clause 57A Entities excluded from definition of “authority”

   Insert after clause 57A (2B):

(2C) The New South Wales Grains Board (constituted by the Grain Marketing Act 1991) is prescribed as not being within the definition of authority in section 3 (1) of the Act for the purposes of Part 2C of the Act.

1. Clause 57A (3)

   Omit “(2), (2A) or (2B)” wherever occurring. Insert instead “(2), (2A), (2B) or (2C)”.
