(CONTRIBUTIONS) AMENDMENT

ACT 1991

AN ACT to amend the Public Authorities (Contributions) Act

1974.

[Assented to 12 December 1991]

The Parliament of Western Australia enacts as follows:

Short title

1. This Act may be cited as the Public Authorities (Contributions)

Amendment Act 1991.

Principal Act

2. In this Act, the Public Authorities (Contributions) Act 1974* is

referred to as the principal Act.

Section 2 amended

3.     Section 2 of the principal Act is amended —

(a) in paragraph (c) of the definition of "financial year" —

(i)      by deleting "a" and substituting the following —

" the "; and

(ii)     by deleting "or (0";

and

(b) in the definition of "public authority" —

(i) by deleting the semi-colon at the end of

paragraph (d) and substituting the following —

(ii) by deleting' ; and" at the end of paragraph (e) and

substituting a full stop; and

(iii)    by deleting paragraph (0.

Section 3 amended

4.  Section 3 of the principal Act is amended —

(a) by repealing subsections (1) to (lc) and substituting the

following subsections —

(1) A public authority shall, not later than 12 months after each financial year, transfer to the Consolidated Revenue Fund an amount that is equal to the proportion of the total revenue of the public authority for that financial year that is prescribed by subsection (la).

(la) The prescribed proportion is 3% for the Fremantle Port Authority and 4% for other public authorities.

(b) in subsection (2) —

(i)      by inserting after "Revenue" the following —

(ii)     by deleting ", (la), (lb) or (1c) of this section"; and

(iii)    by deleting "is" in both places where it occurs and substituting the following —

and

(c) in subsection (3) —

(i)      by deleting "subsections (1), (la), (lb) and (1c) of this section" and substituting the following —

subsection (1) "; and

(ii) by deleting "appointed under the Financial

Administration and Audit Act 1985".

Commencement of increased rate of contribution

5. (1) Where, under an amendment to the principal Act made by section 4, the proportion of the total revenue of a public authority to be transferred to the Consolidated Revenue Fund has been increased, the increased rate commences to apply in respect of the total revenue of the public authority for its financial year ending in 1991.

(2) In subsection (1), "public authority" and "financial year"

have the same meanings as they have in the principal Act.
