AMENDMENT ACT

No. 71 of 1987

AN ACT to amend the Public and Bank Holidays Act 1972.

[Assented to 22 November 1987]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. This Act may be cited as the Public and Bank Holidays

Amendment Act 1987.

Commencement

2.     This Act shall come into operation on the day on which it receives

the Royal Assent.

Principal Act

3. In this Act the Public and Bank Holidays Act 1972* is referred to

as the principal Act.

1983.]

Section 3 amended

4.     Section 3 of the principal Act is amended by deleting "Industrial

Arbitration Act, 1912," and substituting the following-

" Industrial Relations Act 1979 ".

Section 8 amended

5.    Section 8 of the principal Act is amended by inserting after

subsection (3) the following subsection-

"

(4) The Governor may exercise the power in subsection (1) in

order to substitute Monday 25 January 1988 for Monday 28 December 1987 as a public holiday and bank holiday, notwithstanding that the former day falls in a different year from the latter day; and where the Governor exercises the power referred to in this subsection, a person is not entitled, notwithstanding any award, order or industrial agreement made under the Industrial Relations Act 1979, to a paid holiday on 28 December 1987 but is instead entitled to a paid holiday on 25 January 1988. ".

Section 9 amended

6.     Section 9 of the principal Act is amended by deleting "Industrial

Arbitration Act, 1912," and substituting the following-

" Industrial Relations Act 1979 ".
