I, PHILIP MICHAEL JEFFERY, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Public Accounts and Audit Committee Act 1951.

1Name of Regulations

These Regulations are the Public Accounts and Audit Committee Regulations 2005.

2Commencement

These Regulations commence on the day after they are registered.

3Public Accounts Committee Regulations — repeal

The following Statutory Rules are repealed:

  1. ·

    1970 No. 18

  2. ·

    1972 No. 69

  3. ·

    1983 No. 179.

4Definitions

In these Regulations:

Act means the Public Accounts and Audit Committee Act 1951.

Note The Act defines the expressions Chair, Committee and Deputy Chair to mean:

  1. ·

    the Chair of the Public Accounts and Audit Committee;

  2. ·

    the Public Accounts and Audit Committee;

  3. ·

    the Deputy Chair of the Public Accounts and Audit Committee.

5Witnesses’ fees and travelling expenses

For section 20 of the Act, Schedule 1 sets out the prescribed scale.

Witness appearing before the Committee to give evidence because of his or her professional, scientific or other special skill or knowledge

A fee, for each day on which the witness appears, equal to the amount specified in item 49 of Schedule 2 to the High Court Rules 2004.

Witness appearing before the Committee other than a witness described in item 1

A fee, for each day on which the witness appears, equal to the amount specified in item 50 of Schedule 2 to the High Court Rules 2004.

Additional amounts

Witness appearing before the Committee who is remunerated by wages, salary or fees

In addition to the fee payable under item 1 or 2, an amount equal to the amount lost by the witness because of the appearance before the Committee.

Witness appearing before the Committee to give skilled evidence

In addition to the fee payable under item 1 or 2, an amount that the Chair or Deputy Chair considers reasonable for qualifying to give that evidence.

Witness appearing before the Committee

In addition to the fee payable under item 1 or 2:

  1. (a)

    an amount that the Chair or Deputy Chair considers reasonable for travel by the witness to and from the place at which he or she appears before the Committee; and

  2. (b)

    if the witness is required to be absent overnight from his or her usual place of residence — an amount that the Chair or Deputy Chair considers reasonable for meals and accommodation.
