254 (0^) itcEiTSlttt r ANNO VICESIMO TERTIO ELIZABETHAE SECUNDAE REGINAE No. 21 of 1974 An Act to amend the Public Accountants Registration Act 1946 -1971 in certain particulars [ASSENTED TO 24TH APRIL, 1974] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Public Accountants Registration Act Amendment Act 1974. (2) The Public Accountants Registration Act 1946-1971 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Public Accountants Registration Act 1946-1974.
Public Accountants Registration Act Amendment Act 1974, No. 21 255 2. Repeal of and new s . 17. The Principal Act is amended by repealing section 17 and substituting -the following section:- " 17. Qualifications for registration . (1) A person shall be entitled to be registered as a public accountant if he- (a) applies to the Board in the prescribed form; (b) pays the prescribed fee for registration; (c) satisfies the Board that he is of good fame and character, is of or above the age of twenty-one years and (i) is engaged or is about to engage in the practice of his profession or calling as a public accountant either on his own behalf or in partnership with any other public accountant registered under this Act; or (ii) is an employee of a public accountant registered under this Act, so engaged in the practice of his profession or calling; or (iii) has or is about to have the actual personal supervision and management of any place of business whereat a company (including a trustee company) carries on the business of a public accountant; (d) is qualified as specified in subsection (3) or (4); and (e) has acquired such practical experience in accounting work as the Board considers sufficient. (2) Where the name of a person registered as a public accountant under this Act has been removed from the register other than by order of the Board made pursuant to subsection (5) of section 25, the Board may, on receiving an application for re-registration from that person and subject to his satisfying the requirements of paragraphs (a), (b) and (c) of subsection (1), re-register that person as a public accountant. (3) The qualification specified for the purposes of paragraph (d) of subsection (1) shall be that such person has- (a) after due examination- (i) obtained the degree in commerce of the University of Queensland or the degree in economics, of the University of Queensland or the James Cook University of North Queensland; or (ii) obtained the degree in business of the Queensland Institute of Technology, the Darling Downs Institute of Advanced Education, or the Capricornia Institute of Advanced Education; or (iii) obtained the diploma in accountancy of the Department of Education; But where the course of study for a degree or diploma referred to in subparagraph (i), (ii) or (iii) of this paragraph (a), or in subsection (4), does not include subjects relevant to that degree or diploma prescribed by this'Act, he shall in addition pass examinations in those prescribed subjects not so included ; or
256 Public Accountants Registration Act Amendment Act 1974, No. 21 (b) passed examinations, that are of a standard that is acceptable to the Board, conducted by a university or college or institute of advanced education or other examining institution situated in a State or Territory of the Commonwealth (other than Queensland) or any other country, in subjects that the Board considers correspond to:- (i) the subjects required to obtain a degree or diploma specified in subparagraphs (i), (ii) or (iii) of paragraph (a); and (ii) the relevant prescribed subjects. Where an applicant has passed the examinations of any such university, or college or institute of advanced education or other examining institution and the Board is not satisfied that the standard of any such examination corresponds to the standard of the examination required to obtain any of the qualifications specified in paragraph (a) of this subsection the Board, in its discretion, may require that applicant to pass examinations at a university, college or institute of advanced education approved by the Board, in such of the prescribed subjects as the Board considers necessary. Where in any such case that applicant passes those examinations' in those prescribed subjects, he shall be deemed to have satisfied the requirements of this paragraph (b); or (c) after due examination been admitted to a class of membership that is acceptable to the Board, of any institute, association or society or other body of accountants that the Governor in Council on the recommendation of the Board, by regulation, approves as an institute of accountants for the purpose of this Act; or (d) - (i) prior to 3 March 1969, passed the examinations theretofore prescribed and that were conducted by the University of Queensland on behalf of the Board; or (ii) prior to 28 February 1972, passed the examinations for and was awarded the Associateship in Accountancy of the University of Queensland; or (iii) passed the examinations of any institute, association or other body of accountants that, though no longer subsisting at the passing of The Public Accountants Registration Acts Amendment Act of 1968, was at some time theretofore an approved institute of accountants for the purposes of this Act. (4) (a) When at any time after the commencement of this Act a new degree or diploma is substituted for any degree or diploma specified in subparagraphs (i), (ii) and (iii) of paragraph (a) of subsection (3), the Governor in Council, on the recommendation of the Board, may by regulation approve, for the purposes of this Act, the recognition of that new degree or diploma in substitution for the degree or diploma previously so specified.
Public Accountants Registration Act Amendment Act 1974, Vo. 21 257 (b) When at any time after the commencement of this Act a new university, college or institute of advanced education is established in Queensland and the standard of the relevant degree or diploma awarded by that university, college or institute of advanced education, in the opinion of the Board, corresponds to the standard of any degree or diploma specified in subparagraphs (i), (ii) and (iii) of paragraph (a) of subsection (3), the Governor in Council, on the recommendation of the Board, may by regulation approve, for the purposes of this Act, the recognition of that degree or diploma so awarded by that new university, college or institute of advanced education in addition to any degree or diploma specified in subparagraphs (i), (ii) and (iii) of paragraph (a) of subsection (3).". 9
