CaseChat Overview and Summary
The primary legal issues before the Commission were whether the agreement provided for the proper protection of employees' rights and entitlements, and whether it complied with the good faith bargaining requirements stipulated by the Fair Work Act. The Commission needed to assess whether the agreement had been negotiated in good faith and if it included terms that were fair and reasonable for both the employer and the employees. Additionally, the Commission had to consider whether the agreement was likely to promote harmonious, productive and cooperative workplace relations.
The Fair Work Commission, after reviewing the evidence and submissions from both parties, concluded that the agreement had been negotiated in good faith and contained terms that were fair and reasonable. The Commission found that the agreement provided for the proper protection of employees' rights and entitlements, and it was likely to promote harmonious, productive and cooperative workplace relations. Consequently, the Commission approved the PTTEP Australasia Montara Venture Marine and Production Collective Enterprise Agreement 2016, subject to the usual conditions of approval under the Fair Work Act.
The Fair Work Commission's decision was based on the evidence presented and the submissions made by the parties involved. The Commission found that the agreement met the necessary requirements for approval and therefore granted the application for approval of the PTTEP Australasia Montara Venture Marine and Production Collective Enterprise Agreement 2016. The agreement was approved on the conditions that it be registered with the Fair Work Commission and that it be provided to all employees covered by the agreement.
