CaseChat Overview and Summary

PT Industri Karet Deli (the applicant) sought to enforce an arbitral award made in Indonesia against Qingdao Sentury Tire Co Ltd (the respondent). The dispute concerned a contract for the supply of rubber. The applicant sought to have the award recognised and enforced in Australia under the International Arbitration Act 1974 (Cth), which gives effect to the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (the New York Convention).

The primary legal issue before the Federal Court of Australia was whether the arbitral award was enforceable in Australia, notwithstanding that the respondent had not participated in the arbitration proceedings. The respondent argued that it had not been given proper notice of the arbitration and that enforcement of the award would be contrary to Australian public policy.

Justice Brown considered the provisions of the International Arbitration Act 1974 (Cth) and the New York Convention, particularly Article V. Her Honour found that the respondent had been provided with sufficient notice of the arbitration proceedings, even though it had not participated. The court applied the principle that a party cannot rely on its own failure to participate in arbitration proceedings to resist enforcement of an award, provided it was given proper notice. Furthermore, the court determined that enforcing the award would not be contrary to Australian public policy.

The court ordered that the Indonesian arbitral award be recognised and enforced in Australia.
