Protection of the Sea (Prevention of Pollution

from Ships) Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Protection of the Sea (Prevention of Pollution from Ships) Act 1983.

1.   Amendment

1.1   The Protection of the Sea (Prevention of Pollution from Ships) Regulations are amended as set out in these Regulations.

 These Regulations commence on gazettal: see Acts Interpretation Act 1901, s.48.]

2.   Regulation 2 (Interpretation)

2.1   Subregulation 2 (1):

Insert the following definitions:

‘harmful substances report’ means a report about a discharge of oil or an oily mixture given under subsection 11 (6) or (7) or 22 (6) or (7) of the Act;

‘marine pollutants report’ means a report about a harmful substance given under subsection 26B (8) or (9) of the Act.”.

3.   Regulation 6 (Prescribed form—report in relation to incident)

3.1   Omit the regulation, substitute:

Prescribed form—harmful substances report

“6.

(1)   For the purposes of subsections 11 (6) and (7), and 22 (6) and (7) of the Act, the prescribed form for a harmful substances report is the form in Schedule 1.

“(2)

A time given in the form must be expressed as Universal Co-ordinated Time.”.

4.   New Regulation 6A

4.1   After Regulation 6, insert:

Prescribed form—marine pollutants report

 “6A. (1)   For the purposes of subsections 26B (8) and (9) of the Act, the prescribed form for a marine pollutants report is the form in Schedule 2.

“(2)

A time given in the form must be expressed as Universal Co-ordinated Time.”.

5.   Schedule (Pollution report)

5.1   Omit the Schedule, substitute:

SCHEDULE 1 Subregulation 6 (1)

HARMFUL SUBSTANCES REPORT FORM

(For use when reporting discharge or potential discharge of substances to which Annexes I and II of MARPOL 73/78 apply)

  

(Sections of the ship reporting format which are inappropriate should be omitted from the report)

  

A Ship: name, call sign/ship station identity and flag

 

B Date and time of event

 (NOTE: Time must be expressed as Universal Co-Ordinated Time)

 

C Position: latitude and longitude; or

 

D Position: true bearing and distance

 

E True course

 

F Speed in knots and tenths of knots

 

L Route information: intended track

 

M Radio communications: full names of stations

 

N Time of next report

 (NOTE: Time must be expressed as Universal Co-Ordinated Time)

 

P** 1. Type of oil or the correct technical name of the noxious liquid  substances on board

 2. UN number or numbers

 3. Pollution category (A,B,C or D) for each noxious liquid substance

 4. Names of manufacturers of substances or consignee or consignor

 5. An estimate of the quantity of the substances

 **(NOTE: In the case of a probable discharge, item P should be included)

 

Q 1. Condition of ship, as relevant

 2. Ability to transfer cargo/ballast/fuel

SCHEDULE 1—continued

 

R 1. Type of oil or the correct technical name of the noxious liquid  substance  discharged into the sea

 2. UN number or numbers

 3. Pollution category (A,B,C or D) for each noxious liquid substance

 4. Names of manufacturers of substances or consignee or consignor

 5. An estimate of the quantity of each substance

 6. Whether lost substances floated or sank

 7. Whether loss is continuing

 8. Cause of loss

 9. Estimate of the movement of the discharge or lost substances giving current conditions, if known

 10. Estimate of the surface area of the spill

 

S Weather conditions (give brief details of weather and sea conditions prevailing)

 

T Name, address, telex and telephone number of the ship's owner and representative

 

U Ship size and type

 

X 1. Action being taken with regard to the discharge and to the movement  of the ship

 2. Assistance or salvage efforts which have been requested or which have been provided by others

 3. The master of an assisting or salvaging ship should report the particulars of the action undertaken or planned

MARINE POLLUTANTS REPORT FORM

(For use when reporting discharge or potential discharge of substances to which Annex III of MARPOL 73/78 applies)

  

(Sections of the ship reporting format which are inappropriate should not be included in the report)

 

A Ship: name, call sign/ship station identity and flag

 

B Date and time of event

 (NOTE: Time must be expressed as Universal Co-Ordinated Time)

 

C Position: latitude and longitude; or

 

D Position: true bearing and distance

 

M Radio communications: full names of stations

 

P** 1. Correct technical name or names of goods

 2. UN number or numbers

 3. IMO hazard class or classes

 4. Names of manufacturers of substances or consignee or consignor

 5. Types of packages including identification marks (specify whether portable tank, freight container or other cargo transport container, include official registration marks and numbers assigned to the unit)

 6. An estimate of the quantity and likely condition of the goods

 **(NOTE: In the case of a probable discharge item P should be included)

 

Q 1. Condition of ship

 2. Ability to transfer cargo/ballast/fuel

 

R 1. Correct technical name of goods

 2. UN number or numbers

 3. IMO hazard class or classes

 4. Names of manufacturers of goods or consignee or consignor

 5. Types of packages including identification marks (specify whether portable tank, freight container or other cargo transport container, include official registration marks and numbers assigned to the unit)
