Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Protection of the Environment Operations Act 1997.

Explanatory note
The object of this Regulation is to prescribe members of staff of the Royal Botanic Gardens and Domain Trust as enforcement officers under the Protection of the Environment Operations Act 1997, who can issue penalty notices for certain littering offences (under sections 145, 145A, 146A, 146B, 146C and 146E of that Act).

This Regulation is made under the Protection of the Environment Operations Act 1997, including sections 226 (relating to enforcement officers) and 323 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Protection of the Environment Operations (General) Amendment (Royal Botanic Gardens and Domain Trust) Regulation 2013.

2      Commencement

This Regulation commences on 1 September 2013 and is required to be published on the NSW legislation website.

3 Amendment of Protection of the Environment Operations (General) Regulation 2009

Clause 81 Enforcement officers

Insert “the Royal Botanic Gardens and Domain Trust,” after “member of staff of” in clause 81 (6) (k).
