Explanatory note
The object of this Regulation is to amend the Protection of the Environment Operations (General) Regulation 2009 to exempt the operation of diesel-powered generators at the Glebe Island Expo site from compliance with specified provisions of the Act and the Protection of the Environment Operations (Clean Air) Regulation 2010. The exemption is to apply until 1 December 2014. This regulation also makes a consequential amendment to the Protection of the Environment Operations (General) Regulation 2009.

This Regulation is made under the Protection of the Environment Operations Act 1997, including section 286 (1) and section 323 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Protection of the Environment Operations (General)
Amendment (Glebe Island) Regulation 2013.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

Insert after clause 95A:
95B Emissions exemption—Glebe Island Expo site

(1)

The operation of diesel-powered generators on the Glebe Island Expo
site is exempt from the relevant provisions until 1 December 2014.

(2)

In this clause:
Glebe Island Expo site means the land comprised in Lot 10, DP
1065973.
relevant provisions means section 128 (1) of the Act, and clause 38 of
the Protection of the Environment Operations (Clean Air) Regulation
2010, but only to the extent to which:

(a)	Schedule 3 of that regulation specifies standards of concentration for emissions of solid particles, and
(b)	Schedule 4 of that regulation specifies standards of concentration for emissions of nitrogen dioxide (NO2) or nitric oxide (NO) or both, as NO2 equivalent.
