Explanatory note
The object of this Regulation is to amend the definition of prescribed storage tank in clause 68 of the Protection of the Environment Operations (Clean Air) Regulation 2010 to postpone until 1 January 2015 the requirement that certain existing petrol service stations fit storage tanks with stage one vapour recovery equipment.

This Regulation is made under the Protection of the Environment Operations Act 1997, including section 323 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Protection of the Environment Operations (Clean Air)
Amendment (Prescribed Storage Tanks) Regulation 2014.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Protection of the Environment Operations (Clean Air) Regulation 2010

Clause 68 Definitions

Omit “2014” from paragraph (b) of the definition of prescribed storage tank.
Insert instead “2015”.
