His Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the Protection of the Environment Operations Act 1997.

Explanatory note
The object of this Regulation is to amend the Protection of the Environment Operations (Clean Air)
Regulation 2010 to allow the burning of domestic waste on residential premises in the City of Lake
Macquarie in certain circumstances, and to enable Lake Macquarie City Council to approve the burning of
dead and dry vegetation in certain circumstances. Currently, a person must not burn anything in the open or
in an incinerator in the City of Lake Macquarie, unless in accordance with an Environment Protection section 323 (the general regulation-making power) and Schedule 2.

Amendment (Open Burning in Lake Macquarie City) Regulation 2016.
2 Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.
3 Amendment of Protection of the Environment Operations (Clean Air) Regulation 2010
(1) Schedule 8 Local government areas in which burning is prohibited Omit “Lake Macquarie City” from Part 1.
(2) Schedule 8, Parts 2 and 3 Insert “Lake Macquarie City” in alphabetical order.
