1Name of Act

This Act is the Protection of the Environment Operations Amendment (Waste) Act 2007.

2Commencement

This Act commences on 1 August 2007.

3Amendment of Protection of the Environment Operations Act 1997 No 156

The Protection of the Environment Operations Act 1997 is amended as set out in Schedule 1.

4Repeal of Act(1)

This Act is repealed on the day following the day on which this Act commences.

(2)

The repeal of this Act does not, because of the operation of section 30 of the Interpretation Act 1987, affect any amendment made by this Act.

Schedule 1Amendments

(Section 3)

[1]Section 88 Contributions by licensee of waste facility

Omit section 88 (1). Insert instead:

This section applies to waste facilities that are required to be licensed under this Chapter, but it does not apply to a facility that the EPA determines is used solely for the purposes of re-using, recovering, recycling or processing waste other than liquid waste.

[2]Section 88 (2)

Omit “any such waste facility”.

Insert instead “a waste facility to which this section applies”.

Insert after section 88 (7):

In this section:

liquid waste means any waste other than:

  • (a)

    non-liquid waste within the meaning of Schedule 1, or

  • (b)

    a gas.
