His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Protection of the Environment Operations Act 1997.

Explanatory note

At present, licensed waste facilities are required to pay a contribution to the Environment Protection Authority in respect of all waste received at the facility. The calculation of the contribution is based on the amount of waste received.

The object of this Regulation is to exempt dredge spoil (that is, spoil generated by
dredging activities) from the calculation of the contribution.
This Regulation is made under the Protection of the Environment Operations Act

1997, including section 88 and section 323 (the general regulation-making power).
