His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Protection of the Environment Operations Act 1997.

Explanatory note
The object of this Regulation is to allow authorised officers and employees of the Sydney Catchment Authority to issue penalty notices for certain offences under the Protection of the Environment Operations Act 1997.
This Regulation is made under the Protection of the Environment Operations Act

1997, including sections 226 and 323 (the general regulation-making power).

1     Name of Regulation

This Regulation is the Protection of the Environment Operations (Penalty Notices) Amendment (Sydney Catchment Authority) Regulation 2000.

2 Commencement

(1)	This Regulation commences on 1 March 2001, except as provided by subclause (2).
(2)	Schedule 1 [4] commences on the commencement of sections 146A to 146C of the Protection of the Environment Operations Act 1997, as inserted by the Protection of the Environment Operations Amendment (Littering) Act 2000.

3 Amendment of Protection of the Environment Operations (Penalty Notices) Regulation 1999

The Protection of the Environment Operations (Penalty Notices)

Regulation 1999 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

Insert after clause 6 (5) (m):

(n) class 14—an officer or employee of the Sydney Catchment Authority.

[2]     Schedule 1 Penalty notice offences

Insert “, 14” after “12” wherever occurring in column 3 of the matter relating to sections 91, 94, 97 and 100 of the Protection of the Environment Operations Act 1997.

[3]     Schedule 1

Insert “, 14” after “13” wherever occurring in column 3 of the matter relating to sections 120, 145 and 145A of the Protection of the Environment Operations Act 1997.

[4]     Schedule 1

Insert “, 14” after “13” wherever occurring in column 3 of the matter relating to sections 146A, 146B and 146C of the Protection of the Environment Operations Act 1997 (as inserted by Schedule 2 [4] to the Protection of the Environment Operations Amendment (Littering) Act 2000).

[5]     Schedule 1

Insert “, 14” after “5” in the column 3 of the matter relating to section 211
(1) of the Protection of the Environment Operations Act 1997.
