Operations (Penalty Notices) Amendment Regulation 2000

under the

Protection of the Environment Operations Act 1997

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Protection of the Environment Operations Act 1997.

Explanatory note
The objects of this Regulation are:

(a) to prescribe officers and employees of the Forestry Commission as authorised officers for the purpose of issuing penalty notices in relation to breaches of section 120 of the Protection of the Environment Operations Act 1997 (prohibition of pollution of waters), and
(b) to make a number of minor revisions to the Protection of the Environment Operations (Penalty Notices) Regulation 2000 consequential on the abolition of the Ministry for Forests and Marine Administration and to correct certain cross references.

This Regulation is made under the Protection of the Environment Operations Act 1997, including sections 226 (authorised officers) and 323 (the general regulation- making power).

1     Name of Regulation

This Regulation is the Protection of the Environment Operations
(Penalty Notices) Amendment Regulation 2000.

2 Amendment of Protection of the Environment Operations (Penalty Notices) Regulation 1999

The Protection of the Environment Operations (Penalty Notices)

Regulation 1999 is amended as set out in Schedule 1.

The explanatory note does not form part of this Regulation.

Schedule 1 Amendments

(Clause 2)

[1]     Clause 6 Authorised officers: section 226

Omit “of the Ministry for Forests and Marine Administration,” from clause
6 (5) (d).

[2]     Schedule 1 Penalty notice offences

Insert “7,” after “6,” in Column 3 of the matter relating to section 120 of the
Protection of the Environment Operations Act 1997 in Schedule 1.

[3]     Schedule 1

Omit “Clause 16 (4) (c) (iv)” from Column 1 of the matter relating to the
Protection of the Environment Operations (Waste) Regulation 1996.
Insert instead “Clause 16 (4) (b) (iv)”.
