His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Protection of the Environment Operations Act 1997.

Explanatory note

The object of this Regulation is to extend the exemption from provisions relating to overflows from sewerage systems contained in Regulation 10 of the Clean Waters Regulations 1972 to sewers and sewerage systems in a number of additional locations.

This Regulation is made under the Protection of the Environment Operations Act 1997, including section 323 (the general regulation-making power) and clause 11 of Schedule 5 to that Act (relating to regulations made under Acts repealed by the Protection of the Environment Operations Act 1997).

Clean Waters Amendment Regulation 2000

1      Name of Regulation

This Regulation is the Clean Waters Amendment Regulation 2000.

2 Commencement

This Regulation commences on 7 July 2000.

3 Amendment of Clean Waters Regulations 1972

The Clean Waters Regulations 1972 are amended as set out in

Schedule 1.

4 Notes

The explanatory note does not form part of this Regulation.

(Clause 3)

[1]      Regulation 10 Exemption for certain protected waters

Omit “urban areas in Clarence Town, Dungog, Picton, Tahmoor, Thirlmere, Moss Vale, Mittagong, Bulahdelah, Karuah, Tanilba Bay, Mallabula or Lemon Tree Passage, if”.

Insert instead “the urban areas set out in the Schedule to this clause, but only if”.
