An Act to amend the Protected Estates Act 1983 to enable the dele^tion of the Protective Commissioner’s functions and to facilitate the investment of money. [Assented to 21 December 1989]

Protected Estates ( Amendment) 1989

The Legislature of New South Wales enacts:

Short title

1.     This Act may be cited as the Protected Estates (Amendment)

Act 1989.

Commencement

2.     This Act commences on a day to be appointed by proclamation.

Amendment of Protected Estates Act 1983 No. 179

3. The Protected Estates Act 1983 is amended by inserting after

section 5 the following sections:

Delegation

5 a. The Protective Commissioner may delegate to the Deputy Protective Commissioner or any member of staff referred to in section 5 (2) the exercise of any of the Protective Commissioner’s functions, other than this power of delegation.

Protective Commissioner to be corporation sole for certain purposes

5b. The Protective Commissioner is, by this section,

incorporated as a corporation sole under that name for the

purposes o£

(a)

investing money in the common fund and related accounts in accordance with section 58; and

(b) exercising any related or incidental functions.
