Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Property, Stock and Business Agents Act 2002.

Explanatory note
The object of this Regulation is to amend the Property, Stock and Business Agents Regulation 2003 to remove provisions relating to the use of tenant databases by agents. Such databases will be regulated under the Residential Tenancies Act 2010.

This Regulation is made under the Property, Stock and Business Agents Act 2002, including sections 37 and 230 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Property, Stock and Business Agents Amendment
(Tenant Databases) Regulation 2010.

2      Commencement

This Regulation commences on 31 January 2011 and is required to be published on the NSW legislation website.

Omit “1–6A” from clause 11 (1) and (2) wherever occurring.
Insert instead “1–6”.

Omit the paragraph.

[3]      Schedule 6A Rules specific to residential property managers

Omit the Schedule.
